Interesting Ruling

Irrespective of the rights and wrongs in this particular case, this judgement has raised an amazing precedent. Any company can now invite employees to add their names to a VR list which they can hold for future use in the event of threatened industrial action. Following a legal ballot the company would only be required to sever employment with some of those on the VR list and the ballot would be deemed to be illegal.

And this is British justice?

The Judge made it very clear that UNITE cannot appeal against the decision in her court - but they can always apply to Court of Appeal and I suppose this is where they are headed!

If Unite are going to appeal, I would imagine they will now have Gordon on the phone.

There is an election coming and, although Labour may not like it, the unions are perceived as Labour supporters.

I can't imagine they will get much support if they win the appeal.

Can you imagine the PR fallout if they called the strike back on.

It could only happen in the UK.

Quit while you still have some face Unite.

You seem to have forgotten a certain LA-based salad dodger urging people to return a "Yes" ballot even if they had been accepted for VR and knew they were leaving the company.

You BASSA lot really don't know how to tell the truth, do you?

Yes, it IS British Justice, at its best. Which is why there is a right of appeal.

One of my friends took VR from BA. When I saw her a couple of weeks ago, she told me she had been sent a ballot paper even though she was leaving before the outcome of the ballot.

I suggested to her she shouldn't have been given one, to which she shrugged her shoulders and said well it's going back with a YES vote.

UNITE have shot themselves in the foot badly with the mishandling of the vote asides the apocalyptic response to being given a mandate for industrial action. The public is not on their side and other departments realising the gravity of BA's financial predicament, allowed their unions to negotiate sensible changes to their working T & Cs.

You've been had CC and WW will now bury you.

There was no veiled attack on Fincastle...but in the last few weeks he has really over stepped the mark. Calling YES voters morons, scum....etc. I am sorry but I am adverse to people calling me those things. Or do you agree with fincastles "wording".

Why is it though that cabin crew seem to be taken in by BASSA.It just baffles me .The cabin crew workforce have been made to look like idiots(again) having their salaries,lifestyles etc brought to the publics attention.

They are still backing BASSA some saying that unite made a minor mistake with the ballot.It's just unbelievable they never get anything right.

Derek Simpson (On Sky) sounds like a confused old man.

They lost an injunction to stop imposition, and they lost an injunction preventing them from striking. He thinks it's not a level playing field. What in Unite's favour?

No wonder he's retiring next year.

Keeps going on about a negotiated settlement. Er, who's been saying all along "We won't negotiate" and then "We won't negotiate until you remove the imposition".

What a senile old fart. Time for BA Cabin crew to find some sensible, realistic representation. Then he go and race his pigeons again.

Start your own union - Quick, before these chumps try and screw you over again! I wouldn't be surprised if BA offered to pay your setup costs!

IHeartMBT the people who voted Yes fell for the BASSA twaddle, but in the environment where it's force-fed, I'm not really surprised. But they are guilty of failing to establish the facts of the situation, and accepting as the truth their unions false claim of the 175m savings offer, for example.

However, I did refer to the people that whooped and cheered at Sandown at winning their opportunity to up people's Xmas's as "human filth", because in my book that's what they are.

Fortunately, that one little bit of video, released by some overenthusiastic cretin in the room no doubt, did more damage to the BASSA case than BA could ever have hoped for through their own channels.

Crew are far too naive - they have been let down by BASSA time after time and they never get it right no matter how hard they trime - when will crew realise that BASSA will never get it right!?

Funny, because I only thought thats what BA had been attempting for the last 9 months. Maybe I have missed something...

Has Malone resigned here BASSA post now that she grossly mis-lead the members of the union and caused such a disaster for BASSA, and if she has not, have the 13,000 or so of you members asked her to because she has done such a bad job?

Strange goings on north of the channel - sainted isle of democratic foundation, Magna Carta and the unwritten constitution.
How can an organization which has just lost a court case because it stuffed the ballot boxes whinge about democracy being denied?
That is the sort of nonsense we put up with here in Africa-not what one expects from the motherland.

1965 BEA Perhaps this explains things for you:

Carr argued that there were irregularities in the strike ballot held by trade union Unite and that staff who had already been made redundant were allowed to vote on the action. He added that Unite could not reasonably believe that those ex-employees would be called upon to take part in any industrial action.

This, he said, contravened industrial relations law.

Mrs Justice Cox court upheld the argument.

Whatever the rights and wrongs of this dispute, (and I believe the Cabin Crew are neither ignorant, militant, or misguided - just angry at the usual WW management methods, ask Aer Lingus) - I think BA in total, Aviation in general, and Industry all around will regret this day. What's the point of having employment representation, usually known as a Union, if your employer just employs the litigation system to neuter you?
Hands up all those who think that nice Mr Walsh is finished with his cutting of Ts and Cs for ALL employee groups. He's faced down the pilots, he's now won a very significant round one with the Dorises, look out ground handling, engineering etc.

Hands up all those who doubt that management generally will use this ploy increasingly. Gordon has screwed the economy, management (like bankers) are not going to surrender their bonuses, so just who do you think is going to pay?

It may be wise to contemplate that:
  • Unite (knowingly and wrongfully) balloted staff that had left the company.
  • That made the balloting process illegal.
Unite breaking the law is not dependent on the outcome of the ballot. The issue is that Unite acted illegally.

That rather depends on ensuring that the airline can actually survive doesn't it? Or are you in the group that thinks that BA is somehow doing splendidly and doesn't need to cut costs? But given that other departments HAVE accepted cost reduction measures, why not this one?

you don't work with BA cabin crew then do you?

On a daily basis I'm stunned by their misguided and dellusional self worth, their ignorance of the industry they work in and just watch the snow fall tomorrow and you will get to see the militancy we face when flexibilty is required.

Lots of talented great crew in BA, a shame they choose to allow bassa to lie and bully in their name.
