Judging by the tail markings I guess the aircraft is either French or from the USA?

It's American

Only three of this model were built in 1919, and it was found not airworthy after a few test flights in 1921

Interesting the wing struts are similar to those of the Potez 49TOE. This aircraft appears to be smaller than the Potez and has balanced ailerons.

It looks very much like the Orenco D2 PW-3...the version with the oversize ailerons?

Thanks teusje....an excellent but frustrating challenge. I looked at the PW-3 early yesterday evening but of course it was the standard aircraft pictured in Aerofiles, so I moved on. But your clue later on lead me back to it for a closer inspection!

Initial thought was a Miles Monarch.....but not aware that any were captured....will have to do some digging!

Hello

I think the cowling is very "Miles" looking or at least "Gipsy" looking.
I don't believe it's german :the Hirth cowlings had not this look .
Could it be Italian ? Many Italian planes were impressed in the Luftwaffe after September 1943 ...

I wouldn't know LM, but even so the image may be mirrored? Not now sure its a modified Magister. The nose topline looks a little too flat, there's more of a slope on the Maggie and there are differences with the cowling, hmmm
