How to get a JAA ATPL when you work in Asia?

Greetings,

I am a French expat pilot in Asia. I hold 3 licences:
1. CPL HKCAD with a type rating B737-800,
2. DGAC-JAA CPL (with a frozen ATPL))
3. ATPL FAA with a type rating FAA B737.

Expériences en vol :
  • 5100 HdV total
  • 3200 P1
  • 1500 P2
  • 2300 Multicrew
  • 1700 Turboprop
  • 700 Jet
  • 2000 EFIS
  • 2800 Multiengine
  • 3000 Instruments
  • 1000 night
  • 1700 JAA FI/CRI
I need a full JAA ATPL. But at this time it seems that is impossible in France, for different reasons (but maybe I am wrong)…
  • Firstly, because France does not apply the JAA FCL as it is issued by JAA.
  • Secondly because my Type ratings (either from HK or FAA) cannot be added on my French-JAA CPL. Why, because the training organizations where I got the ratings are not approved by the French CAA (no kidding…). Even Alteon, the Boeing Training Organization is not approved by French Aviation Authorities… Could you believe that…
  • Thirdly because any of the (French) Approved FTO never replied to my requests (to get the ATPL practical test required by the French CAA)
  • Because France denied what they call Patchwork Licenses (ie: CPL in France, IR in Germany, Type rating in Belgium, and ATPL in Sweden, etc.). On what basis? I do not know, even though I guess. And as much as I can remember, I never read that in the French FCL-1.
Therefore, I would like to know if someone already experienced such similar situation…

The only solution I am thinking is to ask a transfer from France to another JAA state, where I could add my rating and request an ATPL.

Thanks very much by advance, for your comment advices and (I hope) solution for this very serious matter.

Best Regards,

This should be no issue at all - not even in France:

1st. Is your JAA-ATPL(frozen) still valid?
This might be the issue.

If yes - no problem at all because the type rating needs not be entered. JAA only states hour requirements but not under which license these have been acquired.

Basically the requirements are laid down in:

JAR-FCL 1 (FCL = Flight Crew Licensing)

JAR-FCL 1 1.280 - no requirement for the hours to be flown under JAR.

You may have to take the skill test for the ATPL validation on a JAR-25 aircraft under JAR-FCL rules. This may be the problem.

Try to talk to your CAA directly. Try to get through to one of the competent licensing inspectors. It would amaze me if this is a problem. Else send me a PM (may take a while for answer - but you will get one)

error_401,
Thanks, But JAR are not applied in every state member the same way. It is at their driscretion to use what they want and to reject what they do not want. Therefore every country edited a JAR-OPS and a JAR-FCL that comply with their own regulation on the basis of the JAA JAR-OPS and JAR FCL. No kidding.
  1. In oder to get an ATPL, France request a practical flight/sim test.
  2. As said in my previous post France denied what they call Patchwork Licenses (ie: CPL in France, IR in Germany, Type rating in Belgium, and ATPL in Sweden, etc.). On what basis? I do not know, even though I guess. And as much as I can remember, I never read that in the French FCL-1.
  3. France DGAC does recognize only French FTO, therefore whatever you have done outside France is not recognized and cannot be in your (French)-JAA licence.
It is really a mess, the reason for my post...

Have you ever thought of trnasfering your license to an other JAA state?

This is possible!

Have a look around the TRTO placing adds on PPRUNE and ask those.

Dear Boxshifter,
That is the point. Maybe my former post is not clear.
But as said, some state request a permanent address...
Do you know states that accept easily a transfer, even though, you are not going to live in the country?
Thanks in advance

How urgently do you need a European licence? EASA is in the process of taking over responsibility for licensing rulemaking and it may be more simple when these rules are adopted. It's not a topic that I am involved with so I'm afraid I don't know the dates involved or what is proposed under the new regime but I suspect that there will be clear policies and rules (lots of them, I am sure!) that individual states have to adhere to.

If your need is urgent then you could try the UK CAA. Their reputation may precede them but I suspect that the rules that are applied for your situation will be clearly documented.

Thanks Spitoon,
I know about EASA and its next taking over about FCL.
But according to "my" sources, the new FCL has no date to be issued... and it is urgent... even though I can wait one month or two.

I tried UK before, but they want a permanent address in... UK.
Thanks again.
Other inputs welcome...
