AIUI there is nothing to stop an individual issuing a Criminal Prosecution....ISTR aggrieved parties doing so, when Plod pulled the "insufficient evidence" routine.... the outcome of the case proved otherwise

We just need a dissatisfied Proviation creditor to step up! I'd even throw a tenner in the kitty, for justice's sake.

I ordered from Proviation last year.

The whole process was a joke. My money was taken immediately and the product never arrived.

The order was eventually cancelled and needless to say I have not have a refund.

I am disgusted by the situation as it's daylight robbery. No different to pickpocketing on the street.

No customer service, numerous calls went unanswered, emails went answered. All around this company deserves zero for customer service.

This is my first truly bad experience in ordering online and as stated above, I am left feeling absolutely sickened by such a blatant scam.

At the risk of sounding like a broken record: Obtaining money by deception is a criminal offence.

These guys should take you seriously if you contact them...

Action Fraud | Report fraud and internet crime

I wouldn't even bother with the Trading Standards muppets. They're too inclined to just say, "Please... Pretty please...".

The more people who make reports to this outfit, the more evidence they will have that an offence has been committed and the more inclined they will be to instigate a prosecution. Alternatively, do as others have done and start civil proceedings against Nick although now that the company is heading for liquidation you may have to join the queue (although I'd love to know to where the supposed $20,000 investment has disappeared).
My guess would be Nick's pocket.

I call shenanigans...

Update

Hi all,

Just a little update on my order which I wrote about back in the beginning of February. On 11. February Nick cancelled my order after reading my Trustpilot entry where I used words such as "con" and "fraud" about him and his company. He felt very hurt, the poor man. On the same day he sent me another mail with a copy of the reimbursement message to Sage. This all happened before midnight on the 11th.

The next day I contacted Sage to check if this reimbursement had indeed been actioned. They could not possibly answer that on the phone, but asked me to send them an email. Well I have sent the two emails, neither of which they have answered (has Nick now got a job with Sage ). Nor has the money been reimbursed.

Well actually my last statement is not entirely correct. I instead contacted my credit card provider and through them got my money back today.

Q: How do you know if Nick Ross is lying?
A: Just see if his lips are moving or he is writing an email....

I can help you out a bit here with info on Sagepay.

I've got my own pilot supplies online shop and also use sagepay. Now I can go back to December (possibly further but my store has been live since November 2013) and for each authorised transaction I can expand it and there's a little refund button which, when pressed, will refund the customer.

Unsure what Nick is doing, but he doesn't appear to be pressing it!

As Ispent a great deal of time hinting, I saw all the signs of a company that was emptying the till faster than it was filling. It was pretty obvious the supply of other peoples' money or goods would grind to a halt.
There are circumstances under which a UK limited Company Director can be held personally liable for Company debts.
I'm certainly no lawyer, but I firmly believe that Proviation's trading during the duration of this thread, at least, leaves Mr Ross personally liable for debts.

Creditors should keep up the pressure on the Trading Standards and Police to investigate the Company's activities properly.

Presumably his new target market is airfield operators who, as commercial entities rather than individuals, will want credit accounts.

I'm sure Mr Ross will be happy to give them that facility thus avoiding the issues he is said to have had with people paying up front...

By the way, would anyone googling airfieldequipment.co.uk find a link to Proviation.co.uk and thus be led to this thread?

All those who are waiting for stuff should file an objection with Companies House as creditors stating that they were not informed of said application as required by company law.

That ought to set the feline amongst the avians.

Suspension

Hi all,

I applied for the application for striking off to be suspended. It will be suspended until at least December. At that time, I'm sure that someone else can apply for a suspension, which will have a similar effect.

Proviation owes me money. The dealings that I have had with the company have yielded inconsistent information (at best) - i.e. my refund is being processed, wait another 24 hours, 48 hours, the end of the week, end of the month, we can't process refunds etc...

Unfortunately, I don't think that I will get my money back, but in the meantime I will explore every avenue that I can to do so. If anyone is owed money by this company, then there is plenty of advice in this thread setting out the competent authorities that would be more than happy to hear from you.

Application to strike off

My tenure as the thorn in Proviation's side has come to an end, and the application to strike off is now progressing again.

If you are owed money by Proviation, and you are seeking recompense, then I would suggest that you get in touch with Companies House to ensure the company is not struck off ([email protected]). You will need to provide evidence to show that you are pursuing your debt, e.g. a CCJ.

If you take action, the application to strike off will be postponed which should buy you some time to recover any monies owed. It worked in my case. Good luck to anyone else who has lost money.

You can choose to withhold your details from the directors of the company if you successfully postpone the application to strike off.

I'm so sorry for raising this old thread, but I wanted people to find this in search engine results.

Nick Ross is currently trading as Lifestyle Heritage & Co (lhco.co.uk) under his wife's name Kerrie Ross (nee Kerrie Stoppiello) beta.companieshouse.gov.uk/company/09730132

They are using their middle names for customer facing communications (James Alexander and Angela) - Nicholas James Alexander Ross and Kerrie Angela Ross.

He is using the exact same model as described in this thread:
  • Lists items on his web site as in stock
  • Takes money for the items before shipping
  • Makes endless excuses for delays (Upgrading to new stock system, busy time of the year, problem with supplier, staff training etc. etc.)
  • Ignores requests for refunds
  • Aggressively pursues Trustpilot to remove bad reviews trustpilot.com/review/lhco.co.uk

I hope this helps people in future.

I'm notifying his suppliers in the hope that they will cancel his reseller agreements.

At least he has moved away from scamming aviation hobbyists
