Much as we would like to I don't think we can blame Kerry for the bus. I don't think she is even there yet. Mind you in a few months time when she is in full sail who knows what might happen. She is now in a rising market and I don't think she can possibly make the same mistakes twice. Or can she?

TOM Summer 2011
Disappointing to see TOM will not be operating a larger operation from MME next summer. It say elsewhere that MON will operare the ALC route...I was under the impression that the ALC route was winter only? Does this also mean the PMI has gone too?

SUMMER 2011 CHARTERS
Per above, from the Thomson schedules, it certainly appears that the Thursday PMI-MME-PMI will be operated by Monarch using their EDI-based aircraft on an inside W-pattern. I believe this year the Monarch EDI-based aircraft is an A320, so guess it is a reasonable assumption that we'll get the same again for Summer '11.
Not a great surprise, but looks like Thomas Cook have dumped MME for the time being...no sign of anything planned from them.
...guess that just leaves a few bits from the Turkish operators (Goldtrail Hols, Hols4U) plus Balkan Holidays to wait for.
Overall looking really rather unlikely that there will be any charter growth??

Another year, no growth. I was hoping Thomson would base for 2011 but I guess its too much to hope for.
What MME need to do is offer some mega incentives to get Jet 2 into DTVA. Heavily discounted landing slots, they can make their revenue from car parking etc. Jet 2 are ideal as they advertise flight only or a package holiday (which a lot of people on Teesside will still opt for.)

Airport to seek millions in compensation after winning legal battle with Bmibaby

The Appeal Court today ruled that Bmibaby had breached its contract with Durham Tees Valley Airport (DTVA) when its axed its services from the airport in 2006.
The court's decision is a huge blow to British Midland Airways subsidiary, Bmibaby, which will now have to put the airport financially back in the same position it would have been in had there been no breach of contract.
The airport says it lost huge sums in passenger fees, duty free and retailing profits and car parking receipts.
The Appeal Court's decision was a complete reversal of fortune for Bmibaby which last year won its case at the High Court when a judge ruled that the terms of its contract with the airport were so vague and uncertain they were unenforceable.
Today, Lord Justice Patten, sitting at London's Civil Appeal Court with Lord Justice Mummery and Lord Justice Toulson, overturned that ruling and found Bmibaby in "repudiatory breach" of the contract. The airline now also faces legal costs bills likely to exceed £1m.
The case will now go back to the High Court for an assessment of the damages due from Bmibaby to the airport company.
Lord Justice Toulson said: "The cardinal principle of any assessment of damages for breach of contract is that the innocent party (the airport company) is entitled to be put in the same position as he would have been in if the defendant (Bmibaby) had not broken the contract".
However, Bmibaby's lawyers have in the past attacked as "exaggerated" the airport's claim that it faced "a future expectation loss of some £11,585,306" as a result of the airline's withdrawal.
Hugh Lang, group airports director for the Peel Airports Group, which owns DTVA, said: "Today's judgement totally vindicates the action we have been pursuing for the last three and a half years. The action of Bmibaby in withdrawing their services was totally avoidable and while we found it regrettable to sue our former airline partner they had left us with no alternative. We are very pleased the Court of Appeal has agreed with our interpretation of the contract and that significant damages are now due to the Airport Company to compensate us for our loss."
Bmibaby said it would be appealing the ruling and therefore could not comment further.

Two pieces of positive news at last!! Neither will bring about new services but will surely help secure the short to medium term future of the airport.
Unless of course WW can argue the recession would have brought about withdrawal of services anyway? Or MME management have lost or accidently shredded the projected pax figures the based 2 boeings would have brought in and the associated income from retail etc.
As for new routes, could we include the MME-LYS leg of the MME-DLM Summer route that started today? Before anyone shouts me down this is tongue in cheek!

bmibaby are appealing so this could go on a while longer yet. Even if they lose their appeal, are there any negative knock on effects for us? For instance, someone said airlines won't do business with us through fear of being taken to court if things don't work out, is that not still the case?
Also, I don't know how these things work, but how many times can each party appeal? If bmibaby win their appeal can we appeal their appeal of our appeal???

Above the Appeals Court IIRC there is the Supreme Court (to whome I guess bmi baby will appeal to) and then an European level court. AFAIK if the case got as far as Europe the decision made there would be final as there is no higher court

If MME do ever receive their money, I doubt it will be invested into the airport, it will just line Peels pockets.
If I was an airline, I certainly would not be willing to take a chance with MME in case I got sued if I failed to make a decent margin on my routes.
