Advice note five: Section 53 – Rights of entry

A person (‘the applicant’) who proposes to make or who has made a Development Consent Order (‘DCO’) application under the Planning Act 2008, as amended (‘the 2008 Act’) may apply for authorisation from the Secretary of State for a right to enter land owned by third parties, in order to carry out surveys and take levels and/or in order to facilitate compliance with statutory provisions implementing the Environmental Impact Assessment Directive 2 or Habitats Directive 3 , under s.53 of the Planning Act 2008, as amended (‘the 2008 Act’). This may include the power to search and bore to ascertain the nature of the subsoil or the presence of minerals or other matter in it 4 and/or to take and process samples 5 .

So have Riveroak applied for authorisation? And if so, was it granted??

There's nothing about it on the HM Planning Inspectorate website, and I'd expect any application to the SoS to go via them for assessment and recommendation.

Given how PR oriented River Oak are I'd expect a press release the second they put their application to the SoS in if only to up pressure on people to negotiate.........

RiverOak Investments finalises professional team for Manston Airport DCO

Professional Team - RiverOak Investments Corp

RiverOak Investments has completed the appointment of its comprehensive professional team, which includes legal, aviation, planning, environmental impact, public affairs and public relations specialists, to support its application for a Development Consent Order (DCO) in relation to Manston Airport.

The team is led by eminent London law firm Bircham Dyson Bell (BDB), which specialises in DCOs and offers one of the largest and most experienced DCO teams in the United Kingdom. To date they have acted for the promoters of 11 successfully granted Development Consent Orders with a 12th in progress, and they have acted or are acting for third parties affected by a further 12.

Internationally respected engineering consultancy Amec Foster Wheeler will lead on preparation of a detailed Environmental Impact Assessment (EIA) covering issues ranging from noise, air and water quality to transport impact and historic environment. Amec Foster Wheeler has particular experience in delivering EIAs and consents for DCO applications and other large infrastructure projects, including some of the largest and most high-profile projects such as Hinkley Point C nuclear power station and the third runway proposals at Heathrow Airport - which will become a DCO project should it gain Government support.

Northpoint Aviation Consultancy continues to support RiverOak in all aspects of the airport investment appraisal, forecasting, business planning and due diligence. They are joined by Viscount Aviation, Azimuth Consulting, whose focus will be the further development of a detailed demand and capacity study of the UK air freight market, and Osprey. The latter will support the team on airspace issues relating to the CAA licensing process which runs in parallel to the DCO application. In addition, Mouchel will provide land referencing services to the project.

It is RiverOak’s intention to apply for a comprehensive DCO encompassing the compulsory purchase of the airport and the planning permissions required for the reinstatement of Manston as a successful and profitable airfreight hub, of national significance, with services including:

• a major international centre for air freight;
• a reliever for the major airports of London;
• an extensive aircraft recycling and engineering facility;
• a base for at least one passenger carrier;
• a flight training school; and
• a fixed base operation for executive travel

George Yerrall, of RiverOak Investment Corp, said: “We have had productive initial meetings with the Planning Inspectorate, covering a range of issues relevant to RiverOak’s proposed application. We have now put in place a very strong and experienced team of aviation and planning experts to support us as we move further forward through the process.

“our intention is to consult widely with the community in East Kent and beyond to ensure we hear and can respond to the hopes, aspirations and concerns of people living across the region as part of our proposals. Manston has a strong case to be considered a Nationally Significant Infrastructure Project as it offers much-needed runway capacity in the South East of England and is a resource that should be working hard on behalf of the country, not simply left derelict to be bulldozed for housing and light industrial use that is already well provided for in the local area.”

All the things that Southend is trying to be, with varied success. And Southend is much closer to London with direct rail access from the passenger terminal.

Well the next document to come from these RiverOak Manston DCO planning teams is this Environmental Scoping Report,
Published on the National Infrastructure Planning site, and written by Amec Foster Wheeler Environment & Infrastructure UK Limited:

This document at 216 pages long is just the Environmental Scoping document - i.e. it says what they are going to do and study. Up for discussion with the other RiverOak planners, the Inspectorate, and of course the people of Thanet and Kent.
The final report itself will come much later, when the pre-Consultations in July have been done, and then the actual studies are done and conclusions presented at the main Consultation in the Autumn.

I see river oak have got a glossy advert on the local Thanet news paper web page informing of there plans for manston and dates they will implement there plans and also asking for public opinions

The investment firm working to get planes flying again at Manston Airport have denied claims they would introduce 18 flights per night.

RiverOak recently announced the appointment of a ‘professional team’ ahead of its plans to launch a development consent order (DCO) for the site.

However, it faces stiff competition with the site owners, Stone Hill Park (SHP), submitting plans to develop thousands of homes, and three other separate planning applications.

A spokesperson for RiverOak said the “myth” comes from its Environmental Scoping Report, which relates purely to the accepted methodology for assessing the significance of noise disturbance at night, rather than plans for Manston specifically.

“We know that the reintroduction of airport operations is of concern to some residents and so we are committed to being absolutely transparent at every stage of the DCO process to enable the community in east Kent to make informed decisions on our proposals,” he said.

“Indeed, it is for this reason that our environmental studies will be so thorough and will be published for consultation, along with all other aspects of our proposals, as soon as they are ready.”

RiverOak is hosting a number of informal consultation events this week, where residents can raise concerns with its proposals.

It was revealed last week that a public inquiry is set to be launched into SHP’s plans to change the use of buildings on the site to non-aviation uses.

It comes after the Planning Inspectorate pulled the plug on a scheduled appeal hearing, where four planning applications would have been considered.

It is more than a year since the Airports Commission published its final report on the expansion of airports capacity. During that year, the UK has missed out on at least £9.5bn in potential trade with emerging economies because we do not have a new runway. Those losses will continue to accumulate at the rate of £1.1 million every hour until the runway opens. The South East loses out on £2bn of potential trade each year that passes without runway capacity expansion.

Airfreight is essential to the future success of the UK economy. 40% of our £305bn exports travel by air. That includes anything valuable, perishable or required just-in-time, from Scottish Salmon to pharmaceuticals, Brompton bikes to Formula 1 cars. Today’s report undertaken by CEBR on behalf of Let Britain Fly, shows that the whole of UK plc is missing out huge volumes of trade with the top ten fastest growing emerging market economies because of a lack of runway capacity and connectivity.

We cannot afford to lose more. Government has a clear recommendation from the Commission to build a new runway, allowing us to open new routes to emerging markets and expand existing links. It must decide.
