I think the Huon & Mallee TRA's encompasses pretty much every reasonable routing between MEL and ADL and completely isolates Tasmania from RPT to the mainland... These aren't just piddly little PRD areas linked to a firing range or something small - the Huon one covers the entire state of Tasmania!

Air (no) Services are required as a condition of their licence to have and to do certain things - just as any other licence holder is required to do.

CAR 172.105 Have the management structure to enable it to provide the services covered by its licence.
CAR 172.110 Have enough suitably qualified and trained personnel to provide licenced services in accordance with published standards.
CAR 172.115 Have enough .... supervisory personnel to ensure services provided to standards.
CAR 172.145 Have a Safety Management System to ensure.... and keep it under review to ensure it operates properly.

I doubt anyone would seriously contend Air (No) Services is meeting the legal obligations of its licence(s).
Would the Chief Legal Officer of the Civil Aviation Safety Authority - or the CEO - care to provide a statement of why AirServices is not being prosecuted for any and all of its various breaches?

I'm reasonably sure CASA would prosecute Virgin or Rex if they flew a B737 with one pilot and one hostie (maybe not the protected QANTAS though).
Same thing - WHY is there no prosecution being launched.

The Air (No) Services Safety Management System requires that change be managed in accordance with a safety plan - IE all the changes in the impossibly complex NOTAMS above must have been risk analysed, and the risk mitigation strategies documented, and the resultant evaluated as safe to specified levels, the safety case to be submitted to CASA and approved by them. Would a responsible person........... no, wait, that won't work - would somebody in Airservices care to nominate the date the relevant safety case was prepared, who authorised it, when it was submitted to CASA and when and by whom in CASA it was approved, together with the file numbers so we can use an FOI request to see if any safety process was followed?


I contend that Air Services is no longer qualified to hold its approvals since the requirement is:172.030 When applicant is eligible for approval

For Subpart 172.F, an applicant is eligible to become an ATS provider if the applicant is able to comply with the requirements of Subparts 172.C and 172.D or will be able to do so if the applicant is approved.

Since the regulations above are part of Subpart 172-C and they are not being met..........................



(And yes, for the pickers of nits, I have rather shortened the form of words in the regulations rather than use all the lawyerly words but the context is correct.)

As a LAME of over 57 year’s experience Australian aviation regulation in all areas is on its last gasp, a stinking steaming pile💩
Surely FAA will soon ban all American carriers from using our airspace and demote us to third world status. We should have adopted the NZ CAA regs, shut down CASA and put aviation under direct ministerial control. The next would be to re-employ only the competent.
Ban all aviation regulation management and minister from Chairman’s Lounge and Virgin equivalent.

Don't you feel sorry for the Minister?
Really, if she understood her responsibilities what is she going to do first?

Air (No) Services failing to comply with all manner of Air Safety Regulations in CAR 172 and arguably not meeting the conditions for holding an Air Traffic Services licence, insufficient staff, insufficient supervision, failing to meet the required standards, failing to comply with the required safety management system and on and on..............Minister King: golly, gosh, gee whizz what do I do about Airservices??

Civil Aviation Safety Authority not doing what it is supposed to do:
CASA's functions (1) CASA has the function of conducting the safety regulation of the following, in accordance with this Act and the regulations:
..................................
(c) developing and promulgating appropriate, clear and concise aviation safety standards;

(d) developing effective enforcement strategies to secure compliance with aviation safety standards;

(e) issuing certificates, licences, registrations and permits;

(f) conducting comprehensive aviation industry surveillance, including assessment of safety-related decisions taken by industry management at all levels for their impact on aviation safety;

(g) conducting regular reviews of the system of civil aviation safety in order to monitor the safety performance of the aviation industry, to identify safety-related trends and risk factors and to promote the development and improvement of the system;

etc etc ad nauseum but that is enough for now

CASA has issued AirServices with licences to provide ATS services to the Standards in the Manual of Standards, yep, we have Standards and we have licences, so far so good.
But AirServices is manifestly incapable and not having the required staff to deliver services to the requrired standards.
Has CASA instituted surveillance and has it noticed what the whole aviation world knows? A(n)SA is not meeting the legal requirements for staff, for supervision, for safety management, for meeting the standards.
Has CASA taken any enforcement action? How many prosecutions are before the Courts? None?
Minister King: golly, gosh, gee whizz what do I do about CASA????

Then there is ATSB
The ATSB's function is to improve safety and public confidence in the aviation, marine and rail modes of transport through excellence in:
  • independent investigation of transport accidents and other safety occurrences;
  • safety data recording, analysis and research; and
  • fostering safety awareness, knowledge and action.
An investigation conducted by the ATSB under the TSI Act is independent of other interests, such as commercial and regulatory ones.

Even in my wildest dreams of perfection I do not see the ATSB investigating AsA's lack of adequate services and CASA's lack of efffective action to fix the problems yet ATSB is, by design, the last safety check on the system.

Minister King: golly, gosh, gee whizz what do I do about ATSB missing in action (Ah, sorry, ATSB just might be conducting an urgent investigation, results due by 2026)

That all sounds spot on to me.
This whole ASA saga seems a problem that will take political decision making to repair.
What is to be done? It seems to me that the current mob of controllers are probably working hard in an environment that is stressful. The harder they work and the more stressed they become the more sick days they’ll take at a time where air traffic density is set to increase. I imagine there are controllers being trained but I can’t imagine that is a solution due to the lengthy time involved and ( if it’s anything like flying) the extra staff hours newbies suck up when they are learning the ropes.
The only way I can see to avoid rather embarrassing international headlines and a hit to the economy ( or heaven forbid a mid-air) is to bring in experienced controllers with training paths measured in weeks rather than years.
I fully admit zero experience in solving issues of this nature but would be interested to read people’s opinions of a way out of the current situation.

Are we on par with trying to crew an airliner with only 1 pilot-due operational restrictions?

While it's quicker to bring in experienced controllers the training saving isn't anywhere near as great as as a difference between weeks and years. You might reduce it by a third overall.

Not to mention that the tighter staffing is the less capacity you have to train on the job. There is no quick fix.

Air Traffic Controllers are like Pilots and I'm sure we think the same way with regards to professionalism, training, experience and safety.

Bottom line is that there is a chronic shortage of experienced Air Traffic Controllers and Experienced Pilots within the Australian Aviation Arena at the moment, predominately due to the rubbish salaries being paid in Australia to very experienced professionals - it's absolutely insulting!!!!!

The last major airline accident in Australia was near Lockhart River that involved a Metroliner in 2005, that was attributed to pilot error.

It's only a matter of time before we have a major airline accident in Australia due to inexperienced personnel and inadequate training, that will involve an aeroplane a lot larger than a 19 seat Metroliner!

I think a significant difference is airlines have staff rostered on call avbl to cover unplanned leave, so rarely would a flight get cancelled due to that reason. In ATC each group let's say has 20 staff,.10 are on duty already, and of the 10 that are off say there are 2 on REC, 1 on LSL, 1 on paternity, 1 away on a project, 1 on long term sick leave, then a couple are away for the days off and another couple not interested in extra OT $$s, and then that's it the cupboard is bare and airspace is turned off. So of those 10 that were off 3 years ago 2 got early retirement so now there are only 8 left anyway. Unless there is a system where u can have forced OT or have staff on call nothing can ever change. But to have staff on call requires a ton more staff and a ton more salaries.

I think a significant difference is airlines have staff rostered on call avbl to cover unplanned leave, so rarely would a flight get cancelled due to that reason. In ATC each group let's say has 20 staff,.10 are on duty already, and of the 10 that are off say there are 2 on REC, 1 on LSL, 1 on paternity, 1 away on a project, 1 on long term sick leave, then a couple are away for the days off and another couple not interested in extra OT $$s, and then that's it the cupboard is bare and airspace is turned off. So of those 10 that were off 3 years ago 2 got early retirement so now there are only 8 left anyway. Unless there is a system where u can have forced OT or have staff on call nothing can ever change. But to have staff on call requires a ton more staff and a ton more salaries.
The airline I currently work for regularly cancel flights because they haven’t got crew. They parked the whole Daah 8 fleet up one occasion very recently as they didn’t have crew.
