Is an aircraft’s owner responsible for a pilot’s qualifications?

- United Kingdom.

- Part-NCO “private” helicopter, G-reg.

- hired to a (UK CAA) PPL holder for their own recreational flying.

Is the aircraft owner responsible for the pilot’s qualification. For example, the pilot’s differences training validity. If yes, by which regulation?

I don't believe so, but if the pilot is not correctly qualified I am sure it will invalidate the owner's insurance cover!

Part-NCO with a PPL? Surely this means flying for "hire or reward"?

Part NCO is Non-Commercial Other than Complex - so Private Flying in old money

Let’s please assume the pilot is hiring the helicopter from the owner and genuinely using it for their own recreational uses, often referred to as self-fly hire.

Is the owner responsible by regulation (ignoring for the purposes of this research any best-practice considerations) to ensure the pilot is fully qualified to fly the aircraft? And if so, which regulation?

I don’t think you will find any regulation. There is no compliance system in place that the owner is responsible for. Unlike CAT. Under NCO.GEN.105 / NCO.OP.110, the PIC must ensure before flight that:
  • They hold the appropriate licence and ratings
  • They meet recent experience requirements
  • The flight is conducted within privileges and limitations
  • The aircraft is airworthy and legally usable
