Usually a company needs staff to work a notice period. Pretty sure they worked Mel and Syd HM when they closed. Are you expecting Forstaff to pay you when you are not working?


What's bonus got to do with Sick leave? I would usually say nothing but I think the past bonuses that have been paid to Forstaff employees have an element of burnt leave used within the calculations.

You're part of the problem Bagus, assuming that attitude extends to your workplace.

As SP points out, a notice period is exactly that, the period of notice you are required to give (in either direction) before ceasing work. It MAY be paid out at the discretion of the company but that is not a certainty.

They are full time employees of Forstaff not contractors ffs! at least get your facts right .

To help differentiate employee vs contractor:

Employees usually

1. do ongoing work that is controlled by their employer
2. work hours they’re told to work by their employer
3. are not responsible for financial risk
4. are entitled to superannuation from their employer
5. are entitled to minimum wages
6. have income tax taken out of their pay
7. are paid regularly (weekly / fortnightly / monthly)
8. are generally entitled to paid leave if they are permanent employees.

Independent contractors usually

1. decide how to do their work and what skills they need to do it
2. decide whether to employ someone else to do the work
3. carry the risk of making a profit or loss
4. pay their own superannuation and tax, including GST
5. have their own insurance
6. are contracted to work for a set time or do a set task
7. decide what hours to work
8. invoice for their work or get paid at the end of the contract or project
9. don’t get paid leave.

Of course, this is a test of employee or contractor for Forstaff, not QANTAS, there is clearly not an employment relationship there, there is a commercial relationship between Forstaff and QANTAS.
