He/she is at a specified place (door 12) and is able to start an evacuation is required.
Agreed not necessarily a pilot, and indeed preferably not a pilot who has better things to be doing.
But by any interpretation the guy pumping the fuel cannot comply with the following para.>>

one qualified person should remain at a specified location during fuelling operations with passengers on board. This qualified person should be capable of handling emergency procedures concerning fire protection and firefighting"
Especially if he’s already cremated.

So I’m guessing your airline has found a neat but maybe illegal manner of compliance?
How does the refueled communicate with a purser?
Not being picky! Genuinely trying to find an airline that has found a way of legally circumventing these rules?

At BMA (DC-9 15 series) at LHR we could disembark, and board if the jetty was on the front door when fuel was going on. (fuel was going on as soon as the aircraft arrived on stand sometimes)

Cannot recall what we did if front air-stairs only were down as the -15 had no ventral stairs, but the -32 series did have them so fuelling whilst boarding was OK.

Viscount and 707 was OK if we had 2 sets of steps put on (On the front and rear doors)

Ground Oily was always around dealing with the Shell chaps, Despatcher/Traffic guy/girl was aware, and FD crew were on board or doing a walk around. CC were on board too.
Pax PA's were made - no smoking allowed - of course!

Bit of nostalgia for you....

Yes Rog
In the good old days we had these guys cruising around the plane keeping an eye, or maybe not, on things.
But now in LCC world there are no spare bods.

Nowadays they seem more interested in faffing about wasting precocious turnaround time having a couple of bods first stringing up some piece of Meccano kit strewn around the ramp with chain link ropes attached to bollards to stop the pax from walking under the wing LOL - In our day we just put the No.4 bird out there to stop such foolishness lol
