They certainly can't deny LSL, but they can tell you it will be multiple years before it will be available....and that's fact, unfortunately.

Why am I not seeing representatives of the AFAP, TWU, etc on the six o’clock news making lots of noise about AsA not meeting their legal obligations and also CASA not pressing them? Truly amazing,

The entire industry and its oversight is like an episode of Yes, Minister. Imagine how much time
and money CASA have spent trying to cover their tracks and weasel out of responsibility for the whole Glen Buckley debacle. They could have apologised, offered compensation, and then spent their time on fixing the industry.

How long before a flight crew walk off the job due to ASA shortages and it hits the news?

I don't disagree with your concern re The Next Big Thing - but there will be no one found at fault except the two poor buggers in Row 0.

They were fatigued, or they didn't deconflict with AirBumphuck flight 558 as required under TIBA Contingency procedure 5.52, chapter 69 paragraph 15 section 2 or they didn't understand the interrelationship of the ADAHRS with the stick shaker and that the 4th MEL'd system that day didn't supply the FADEC with airspeed data, or whatever other bull**** they come up with. There will always be a reason it is never the fault of anyone above the operating crew, it's the way "the system" is set up these days - to protect those whose snouts are in the trough.

In a true safety culture, they would identify such serious systemic issues but that kind of mindset is looooooong gone, sadly. All we can do to avoid starring in our very own ATSB report is use your common sense and experience to say "No". No to flying through TIBA, no to accepting a jet with multiple deferred defects, no to extending or using your discretion for the 8th time this fortnight and a hard no to coming in on OT to cover shift vacancies - no matter what side of the radio you're on.

However in the modern era you need to be careful a safety issue is not then turned into an industrial one. This is what the real issue is here. CASA need to be standing up and protecting airspace users. It is not up to the PIC to declare TIBA unsafe it is CASA’s job. If CASA say it is safe to fly in then how as PIC do you disagree without it becoming an industrial issue?

If u read the notams they r TRA (not strictly TIBA) and u need to ring a ph number for approval in CTA, and in G u can ring same number for further info.

The classes of airspace don't change. The CTA part (A/C/E) is TRA, & the G is sorta kinda like a TIBA albeit u may or may not have to get phone approval ? Bit unclear that bit !

TRA with TIBA frequencies = TIBA?

Or is it enhanced TIBA because of the dual frequency requirements?
Or is it enhanced TIBA because frequencies shown on the contingency maps aee monitored in the case of an emergency?
Or is it enhanced TIBA because of TCAS and transponders?
Or is it enhanced TIBA because aircraft may remain logged ADS-C/CPDLC?
Or is it enhanced TIBA because anti collision lights?

Perhaps these "enhancements" make it safe and allows the CASA and ASA CEOs to sleep at night.

And make sure you pay attention to the NOTAM requirements if you're operating in the underlying Class G airspace - some NOTAMs require you contact BN/ML CTR if you're operating planning on operatingIFR in G. Others require you to contact CTR if you're planning to operate in G irrespective of flight category.

Would the Chief Legal Officer of the Civil Aviation Safety Authority - or the CEO - care to provide a statement of why AirServices is not being prosecuted for any and all of its various breaches?

I'm reasonably sure CASA would prosecute Virgin or Rex if they flew a B737 with one pilot and one hostie (maybe not the protected QANTAS though).
Same thing - WHY is there no prosecution being launched.

The Air (No) Services Safety Management System requires that change be managed in accordance with a safety plan - IE all the changes in the impossibly complex NOTAMS above must have been risk analysed, and the risk mitigation strategies documented, and the resultant evaluated as safe to specified levels, the safety case to be submitted to CASA and approved by them. Would a responsible person........... no, wait, that won't work - would somebody in Airservices care to nominate the date the relevant safety case was prepared, who authorised it, when it was submitted to CASA and when and by whom in CASA it was approved, together with the file numbers so we can use an FOI request to see if any safety process was followed?


I contend that Air Services is no longer qualified to hold its approvals since the requirement is:172.030 When applicant is eligible for approval

For Subpart 172.F, an applicant is eligible to become an ATS provider if the applicant is able to comply with the requirements of Subparts 172.C and 172.D or will be able to do so if the applicant is approved.

Since the regulations above are part of Subpart 172-C and they are not being met..........................



(And yes, for the pickers of nits, I have rather shortened the form of words in the regulations rather than use all the lawyerly words but the context is correct.)
Agreed. AsA CEO has previously held roles as GM Safety and GM Air Traffic Control so he would be very familiar with all 172 rules and regulations.

Having sat across the other side of the AACC from him 25 years ago and recalling him being wet behind the ears and described by some as ‘dangerously ambitious’, I wouldn’t be surprised.

Similarly AsA Vice Chair had the same roles within AsA then was on CASA exec and then ATSB commissioner before returning as board member so there should be nothing that is unknown within the organisation.

For safety, the NOTAM works on an odds and evens methodology: Aircraft with odd RNP specification numbers can fly VFR in an E TRA on odd days of the month; those with even RNP specification numbers on even days.
