not paid

Anyone have some ideas of how to get money out of a company that hasn´t paid me for the last month? It was a UK company.

Not the first time they have done this, I have found out, but that doesn´t make me feel much better.....

1. Go to citizens advice bureau.
Rights to pay
Check to see if you have any free legal advice cover with BALPA or on your home insurance

2. Get your CV out there!

When someone owe you something and are unwilling or unable to pay up, you are ultimately looking for a bankruptcy petition. If they can pay, it tends to speed things up, if they can't, then it may force them into liquidation so you can get your rightful share.

Go see a lawyer. It tells them you are serious.

Now that was a rather good idea. Solicitor visit scheduled.....

Thanks.....

Ask them.......have done that, sent the invoices, been told wire transfer would go out Monday, or Tuesday. Asked on Wednesday for the confirmations.....
It will go out Thursday.
Friday "it is in the works"
Monday....."You know what your problem is, you are arrogant? I told you I would pay you! You earn too much money! You´re not getting anything from me!" An exact quote......

ask them indeed.......

aircraft repossessed upon return to UK.

"That is an illegal possession!"

"The bank didn´t think it was a good idea to have the aircraft at this junction."

"Would you help me find a good Falcon 900?"

Well myself along with other colleagues were in the same boat you were about 7 years ago.

A captain with our airline thought he would do the evil deed to the company because of lack of pay too.

He started out with 173 passengers from Point “A” to Point “C” with a tech stop at Point “B”. Point “B” was a fueling stop. He set out for Point “B”. Once at Point “B”, he got off his jet, thus stranding 173 passengers at Point “B”.

The captain left his First Officer and Flight Engineer, and 5 cabin crew to deal with the passengers and the ensuing problems without warning.

There were another 173 passengers and full flight crew at the ultimate destination for the return trip back to Point “A”.

After the captain got off the jet in Point “B” he jumpseated back to Point “A” on another carrier. He did however leave a phone message with the company that he resigned with immediate effect, before departing Point "B" back to Point "A".

He was to join another carrier with a class date commencing in about another week or two after this episode. You know the saying about how small the airline community… news travels fast and rumors grow faster than germs in a petri dish. Well that escapade got around the airline community. His next employer rescinded their job offer after they caught wind of what he did... oh well... such as life.

The company he thought he was sticking it too, because of no pay, sued him with success may I add.

As for myself, and others still with the company at the time, gave our proper two week notices, called in sick for trips well in advance so the company could find a replacements.

Unfortunately, there is very little an attorney can do other than have a “Mechanics Lien” placed on the aircraft and other associated assets. Well the owners of this bottom feeding carrier walked away from the company, as this particular company was in deep financial problem. As the aircraft and ground equipment were all leased they were returned to their rightful owners. There were no back salaries ever recovered by the flight crews and other employees of the company.

Yeah… I know it would feel gratifying to shaft the company for lack of pay. But one needs step back and think about the fallout left in the wake of that type of melt-down behavior… as there is no turning back.

Anyway after some 10 years later, the individual who sought retribution is a SLF flying who knows what. The rest of us who left the company the “proper way” are gainfully employed with reputable carriers.

You can't file a bankrupcy petition on them until you have won the case against them in court and given them time to pay. It would also cost you a few quid, good money after bad. cheapest and quickest way is the small claims court, it is cheap and easy. if they don't defend the case it will be found against them quickly, you can then ask them to send a bailif to collect.
They may try to defend the case and mess you arround for a while, and of course, when you win, they may have no assets for the bailif to seize.
if they go bust, you can claim unpaid wages and holiday from the government scheme, but it is capped at so much a week. Not sure of the current figure.

I could never do what your former colleague did, stranding passengers like that. We both stayed with the aircraft for 14 days and despite not being paid, gave 14 day advance notice, thinking it would get his attention.

"We will leave the aircraft in Paris, if we aren´t paid." I really believed that this would work and he would pay us.....but nope. He managed to find a couple of free-lance pilots, who were asked to show up the day after arrival (so we wouldn´t meet) and they continued. Carefully planned in order to get out of payment. When they returned to EGKB the next week, the bailiff was there and the aircraft arrested, as he hadn´t paid the lease payments and there we stand.

Will try solicitor and small claims and see if it leads anywhere.....thanks all. Will update if I learn anything!

I managed to get money out of a company, cost a few bob but it gave me satisfaction. The soliciter road is a good one to take depending on how much you are owed. It worked for me on an offshore company.

You don't need a solicitor for the small claims court, in fact it is set up especialy for the individual to deal with things themselves. you just walk into the local county court and fill in the forms. It only costs a few quid, and this is added on to the claim. if you push, it all happens fairly quickly. you don't just leave it to them though, you need to keep an eye on the progress and as soon as one time limit has expired, you need to ask them to move quickly to the next stage. Also, when you win judgement, ask asap for them to send a bailif to collect.

As Ballsout said,- the plaint-fee varies according to the amount claimed.
Neither party can claimany other legal fees, except an "expert report" (usually with respect to claims for faulty workmanship/materials/tech. issues) this is capped at ~£200.

If the defendant loses/does not file a defence (loses by default) the cost of the case is added onto his bill, plus you get to nail him for your time/fuel/fare wasted going to court.

warning! Make sure you send written warning that, unless you have full settlement within "X" days (7 is enough at this stage) you will take legal proceedings for recovery without further warning.

then do it!...court even has a DIY kit of leaflets, explaining all the stages and how to complete the forms.

Last "tricky-dicky" I took, had to pay the lot, plaint-fee, expenses and expert report cost. it also cost him about 5 solicitor's letters whilst he tried to frighten me into giving -up.
his only satisfaction ,- he had the hearing transferred from my local court, to his....the defendant is allowed to move the hearing to where the alleged incident took place, I believe.....but then it cost him more expenses for me to travel!
