Planning minima with regard to wind

Is there any legal issues related to planning minima with regard to wind ? Say if you had a strong westerly wind but the runway only had a NDB in that direction with a high RVR minima. Could you for example plan to take a tail wind to land on the other end that had the ILS ? Say accepting a 10 knot tail wind. Would you need 2 alternates ?

Only adding pointers that may be relevant to the question (EASA land)

GM1 CAT.OP.MPA.185 PLANNING MINIMA FOR ALTERNATE AERODROMES
Non-precision minima (NPA) in Table 1 of CAT.OP.MPA.185 mean the next highest minima that apply in the prevailing wind and serviceability conditions

CAT.OP.MPA.110 Aerodrome operating minima
(e) The minima for a specific approach and landing procedure shall only be used if all the following conditions are met:
(1) the ground equipment shown on the chart required for the intended procedure is operative;
(2) the aircraft systems required for the type of approach are operative;
(3) the required aircraft performance criteria are met; and
(4) the crew is appropriately qualified.

In the US, as long as you could reasonably expect to get the ILS. You wouldn’t necessarily need an “extra” alternate.
