No - he hasn't.
Judge ruled in the owners favour.
Second judge allowed an appeal.
Third judge delayed the appeal, cos Mr B needed more time for his case.
That's the current situation.
This is posted in the wrong forum though, this is GA of a bigger nature - you need to put this is either Private Flying or Airports.

Interesting.
My view is that if you don't understand this thread then you need not. No sense in airing a tawdry and acrimonious affair in public.
It would be useful to see the result of the appeal here though.

Wee Weasel - it would nevertheless be nice to know if this is a matter affecting the operation and use of Welshpool by resident AND visiting pilots.
If it's so private and cryptic, why not just a pointer to a nice secret little discussion group?

Whirly - nothing to worry about at the moment. Don't cancel your flying just yet.
As WWW says, it has been an acrimonius affair for the best part of eight years, so I'm not expecting any major changes. If you don't know what this refers to, it's nothing to affect you, so please sort of ignore it. I know that'll be difficult, but the minute I hear anything I'll post it and all will become clear(er).
Poet it's nothing to do with safety or the operational nature of the place, so there are no concerns at all for based and visitors. In fact, go and visit the place - it's a lovely part of the world.

All I can say, for fear of being sued..., is that I would suggest someone with legal access to judgements faster than those available on the <a href="http://www.courtservice.gov.uk" target="_blank">www.courtservice.gov.uk</a> website should check the result of the Appeal to the Court of Appeal - Civil from the case BJ Aviation Ltd v. Pool Aviation Ltd, from Friday, 18th January 2002.
The moment the judgement appears on a linked website I will post it here. Until then, please, please, invest in a credit check against any company you may be considering paying vast sums of money too - paying particular attention to Appeal court judgements.
I'm sure you can all make assumptions about what that means, however I can make no further comment until I have a link to provide.

Actually I dropped into Welshpool today for a coffee, since I was passing through. It was only about 4pm, and though it was very windy, it really wasn't a bad flying day; I'd been flying earlier and it was OK. But the place appeared deserted and at first I thought no-one was there. Then I found an engineer and an instructor in a hangar I'd thought was locked. They said everyone had gone home early because the weather was so bad. But the instructor opened up and made me a coffee, and also took money from someone who landed, who seemed mildly confused that there had been no-one on the radio in quite flyable weather. I am still awaiting the electronic copy of the judgement, however it is alledged (does that cover me?!?) that:
In the Appeal Court on Friday, 18th January 2002, in the case BJ Aviation Ltd v. Pool Aviation Ltd it is my understanding that the court ruled that Pool Aviation Ltd must give up their role as Operator of the Welshpool Airport by 15th April 2002.
I would imagine (as in similar cases) that this would have an effect on their future.
The electronic version of the judgement should be available today or tomorrow and I will post it here.
If someone else feels like pointing out how this 'could' effect people who are about to pay upfront, please speak now.....
