I received this PM from Mr Phelan:

If you're sitting in the RH front seat an R44 and you're average height, the windscreen pillar isn't straight ahead of you; it's off to your left and where the pillar intersects the horizon it's probably sloping back about 20-30 degrees. Try sitting in your car and looking across to where the LH windscreen intersects the horizon. Depends on the slope of the windscreen, yet to listen to all the helo pilot "expert witnesses" it seems they think it's at right angles to the horizon. How the hell can anybody sit in a Bell for 12,000 hours and still think the windscreen is vertical? This may explain why they're still helo pilots.

Creampuff, additional to the curved windscreen issue, the camera is handheld and the operator twists it as he moves away from the straight ahead position which increases the apparent angle of bank.

You guys should of seen who the CASA expert witnesses were , I doubt very much if total hello time between the whole lot of them would of been more than 700 hours combined , also you could ask where their star witness has been residing on and off these past 4 years , ( hint ,motel style accommodation out side of Mareeba, with armed doorman)

You should have seen the feeble attempt at discrediting the defending expert witness. One who allegedly knew nothing about aerobatic flight and landing on floating platforms.

Of course a LtCdr from the RN who flew SHAR's and other jets off aircraft carriers would hardly know what he was talking about. :ugh::ugh:

Frank Cox was appointed to the AAT as a part-time member on 24 August 2006. He trained with the Royal Australian Air Force (RAAF) as a pilot and held numerous flying and staff appointments during his military career. The last senior appointment he held was Assistant Chief of the Defence Force - Personnel.

Air Vice Marshal Cox is a graduate of the Royal College of Defence Studies (London) and the USAF Air War College. After service with the RAAF, he worked as a consultant in human resource management.

He was appointed to the Defence Force Remuneration Tribunal in 1999 and held the position of ex-service member for a period of six years.


He's the one who knew the "expert witness" in JQ's case and did not recuse himself.

Interesting appendix, I was truly astounded at the amount of tossers, trough dwellers, has-beens, Nupty's, ass lickers, mates rates, spin doctors and career bull**** artists listed in there!
Of course there were a handful of decent folk, but overall I became nauseated and had to stop reading.

UITA, I would suggest you don't let Gobbledock see that list, all hell will break loose, you know how he can get.

Welcome to the "justice" system of Australia... While not commenting on the example above as I'm not overly familiar with that case, you do see on many occasions lawyers with marginal ethics/behaviour appointed as judges or other high legal office positions). At least three spring to mind over here in the West.

I'm looking forward to the day a Judge Rayney is appointed (only those in WA will understand that sorry).

Raison d'ętre.
 
Aircraft weren't around when the Divine Comedy was written. The stanza which contains the "Abandon all hope, ye who enter here" quotation was not intended to reflect the Australian Administrative Appeals Tribunal. But it fits damned neatly; CASA have their act refined to fine art status and the game sewn up to a fare thee well. I did not believe the Bartsch appointment when it was first mooted, dismissed it for heresy, a prank or the usual disinformation. Clearly, I was very wrong, and yet so right at the same time. No one to blame but ourselves really, a bit like pregnancy; – easy to achieve – bloody hard to undo.

Hope Truss cracks on and makes the reform work; then we can be like the rest of the world and not need to be dragged into the tribunal to defend the family jewels.

Take care and do not get caught, lest the smallest thing is parlayed into another Quadrio event. The AAT where even if you prove you were not even there, let alone guilty; your nuts are 'raisons'.

The Quadrio case gets another hit in the ekinci matter.


In Quadrio and Civil Aviation Safety Authority [2011] AATA 709 the Tribunal observed that it is possible to say that a fit and proper pilot is one who has an appreciation of the statutory responsibilities and one who discharges them.

The Tribunal observed that:

17. “It is not open to a pilot, a fortiori a commercial pilot, to determine which rules ought to be obeyed. And it is not open to a pilot to ignore the manufacturer’s recommendations regarding performance. ...”

In Quadrio the Tribunal [at 69] stated: “In determining whether [the applicant] is a fit and proper person we are not concerned to enquire into [the applicant’s] competence. On the evidence it would appear that [the applicant] is a technically competent pilot.”

The Tribunal found there, as does the Tribunal in this matter, that what is most important is the applicant’s attitude to compliance with the civil aviation regulatory regime.
In fact:

A. casa never identified the pilot who actually flew - Quadrio denies he was the pilot of the "offending flight" Exhibit "E";

B. casa never established that the helicopter was flown outside normal operating standards [Robinson did not concur with casa's view, neither did their expert witness at the Criminal charges that CDPP declined to prosecute in Cairns] and

C. casa did not provide all the evidence in order that Quadrio could defend himself properly.

I heard a story one of the individuals from CAsA who so corruptly pilloried John Quadrio has left the organization for a cushy little number back in the GA. Wouldn't it be interesting to see who signed off on all their shelfware before they left?

AE – Glad you caught that; Hope and Truss in the one sentence, not certain whether it makes one cry from laughing, or laugh from crying. Truss fluffed it in 2008 and with the speed of a well trained racing tortoise is slipping away from his responsibilities in 2014. Given time and assistance the entire 37 WLR recommendations could end up diluted, deferred and dismissed with his tacit blessing; the sappers will be at work as we speak. The reliance on the new board and DAS to take on the 'status quo' could easily be subverted. Can the AAT fiasco be fixed? If Truss only ever did one useful thing before going completely ga ga, it should be removing double jeopardy from the equation; that would be enough. Quadrio is classic – CDPP said no case to answer; no problem says the boys from Sleepy Hollow; we'll do him in the AAT, and they did. It's a ridiculous situation.


LS - I can think that I can say, with great confidence, that in order of importance, aviation is not on his top 10 "to do" list, indeed, about the only aviation matter of interest to the Government is: "Would it have any effect on re-election of the Government if Qantas went broke or real control was sold off".
Crumbs, if 'industry' is low priority, where does that leave attending to the 'daily' details, like administrative embuggerance; aided and abetted through the AAT system.
