EK - FTLs Annex 2

Guys!

Reading throught chapter 7 I was trying to figure out the following:

Can you have a pairing that uses the Annex II variation departing DXB let's say 04:00 in the morning. The variation states that one should have one local night's rest IMMEDIATELY prior to duty and since you are reporting in the middle of the local night (22-08) isn't then impossible to use Annex II?

That would be possible. Your local night is the previous one. It's classed as immediate as no duty would be planned before the variation. It's to avoid you operating a duty which gets back anytime the previous day which would have infringed on the definition of a local night. So, say your duty departed 0400 Friday, you would have needed to have landed by 2330 on the Wednesday. That Wednesday night becomes your local night as you'll still get the required 8 hours between the hours of 2200 and 0800. Your example would, ironically, be almost the least efficient use of variation for the Company and is, for once, in your favour. If you call a 4am departure a good thing!

Thanks! Yeah, guess that makes sense. It was the "immediately" that got me wondering...
