IRS Per Diem TAX Laws (for the purpose of flying in Saudi)

Gentleman, I've talked to my tax accountant, he said my per diem is taxable, but I beg to differ and wanted to see what your experiences were like.

Scenario: 2 months on, 1 month off

Company gives X dollars per month for per diem, separate from our salary. I'm responsible for filing as they don't withold any taxes.

Can anyone find (or if you have found) legal documentation to support that we can't be taxed on our per diem that we receive from an overseas carrier?
