Flight Sharing ..... lo sapevate?
Ciao a tutti,
visto che ormai "condivido spesso" il lavoro che seguiamo in Europa, aggiungo anche questo....
In poche parole, una determinata Società, sta prendendo piede in Europa. Fin qui tutto ok!!! Anzi...di questi tempi...ce ne fossero....
Vi è un solo "problema"...una piccola "particolarità".....
I Piloti coinvolti sono PILOTI PRIVATI (detentori di PPL) e NON Piloti Commerciali!!!
Questo crea un grande problema in quanto, ovviamente, operano a tutti gli effetti un trasporto pubblico passeggeri......
Allo stato attuale stanno allargandosi a macchia d'olio in Francia ed insieme al Collega Francese, stiamo ricorrendo in tutti i modi all'EASA la quale, con una lettera recente assai poco chiara, non prende in realtà una posizione ben definita.

No non lo è, ma nessuna NAA emana la chiusura del sito e questi continuano a fare come vogliono. EASA ha semplicemente risposto che debbono attenersi alle regole previste (?) tutto qui.....stanno prendendo piede anche in Germania.....qui in Italia avevamo già visto "qualcosa di simile" con Cpt R. ..... Ricordate? Ma non in questo "grande stile"......
Ora stiamo cercando di cambiare le diciture della "basic regulation" in modo di mettere ancora più in chiaro l'illegalità di tale processo (anche se già è chiaro quanto basta...)
Di certo nessuno di noi si capacità di come nessuna Nazione riesce a disporre l'oscuramento del sito....

Io ricordavo che finchè i passeggeri partecipino alle spese non s'infrange nessuna legge, 4 amici di cui uno pilota PPL dividono in 4 la spesa per andare all'Elba e ritorno.
Se invece ci si vuole guadagnare bisogna essere titolari del CPL o ATPL, ameno che in Europa sia cambiato qualcosa...

Thank you for your email of 20 January 2016 regarding the relationship between your online platform ‘Wingly' advertising cost-shared flights and Regulation (EU) No.965/2012 (Air OPS Regulation).
Under Art. 64a (a) of Commission Regulation (EU) No 965/2012 (Air OPS Regulation), cost-shared flights by private individuals on non-complex aeroplanes and helicopters, balloons and powered sailplanes may be operated in accordance with the rules of Part-NCO (non-commercial operations with non-complex aircraft), on the condition that the direct cost is shared by all the occupants of the aircraft, pilot included, and the number of persons sharing the direct costs is limited to six. Under the derogation, the sharing of annual costs is not permitted. Please note that Part-NCO of the Air OPS Regulation only applies in France as of 25 August 2016. Until then national rules apply. Additionally, Article 3.2 of Commission Regulation (EU) No 1178/2011 (Air Crew Regulation) establishes, that holders of private pilot licences may carry out flights referred to in Article 6.4a of the Air OPS Regulation, 'without prejudice to compliance with any additional requirements for the carriage of passengers or the development of commercial operations', defined in the Air Crew Regulation.
Therefore, I can confirm that the derogations of Art. 6.4a (a) ofthe Air OPS Regulation and Article 3.2 of the Air Crew Regulation apply to operations that advertise on ‘Wingly', provided that those operations comply with the conditions mentioned above and that Part-NCO of the Air OPS Regulation applies. However, we would like to bring to your attention that it is important that the nature of these flights is clearly specified to the interested public. The Agency intends to initiate a discussion with Member States to agree on best practices to ensure that proper information is made available to the public. We have also invited you to a meeting on cost-shared flights at EASA on 13 April 2016 with national aviation authorities (NAAs}, who are members of the EASA EPAS Action Group. We look forward to your participation to this meeting.
