This is not the whole picture. The Health Act 2006 establishes the framework that requires the Government to introduce the Smoke Free regulations- which they did, the link is in my post to Phil.

The Smoke-free (Exemptions and Vehicles) Regulations 2007 provides, as I mentioned above - that Aircraft are exempt. It's true that they do constitute vehicles under the Health Act 2006 - but they are specifically exempted under the 2007 regulations for the reasons I explained.
