WTF ! Qantas FAM says I'm not to fly in TIBA airspace, but ATC strikes are making this impossible, great system. Is anything being done about this mess?

Strikes?
I believe you might find we haven't yet reached that point, and likely won't.
I'm not going to comment on why you find TIBA airspace out there, a bit of research will provide the explanation.

Legal Implications of This Thread???

I am not a lawyer though I have been known to tell lawyer jokes, see # 86 of this thread.
And I have prompted one very learned lawyer to respond, see # 91 also.

We are all indebted to SunnySA for her efforts in gathering all this evidence together for the subsequent investigation(s) – please keep it up.

Both Airservices and CASA are corporations set up by the Commonwealth Government:

AIR SERVICES ACT 1995 - SECT 7 Establishment of AA
(1) A body called Airservices Australia is established by this subsection.
(2) AA:
(a) is a body corporate; and …………

CIVIL AVIATION ACT 1988 - SECT 8 Establishment of CASA
(1) An authority called the Civil Aviation Safety Authority is established by this subsection.
(2) CASA:
(a) is a body corporate with perpetual succession; …………….

In this appeal, the High Court held that the ‘Crown’ is only to be understood in the narrow sense of the body politic itself. There is no common law presumption that a criminal penalty does not apply to a servant, agent or instrumentality of the executive government where a law is in terms directed to a ‘person’. Servants, agents or instrumentalities of the Crown will be subject to that penal sanction in common with any other private citizen.

If ever this judgement is considered in the exclusive, highly remunerated executive suites of AsA and CASA the concept that they may have some RESPONSIBILITY attaching to their positions may arise.

AIR SERVICES ACT 1995 - SECT 9 Manner in which AA must perform its functions
(1) In exercising its powers and performing its functions, AA must regard the safety of air navigation as the most important consideration.

And yet this collection of evidence is comprehensive proof that this provision is not being complied with; pilots on this site have compared the standard to Botswana, Lesotho, etc.


To digress, On 5th October 1999 two trains collided at Ladbroke Grove, London. 31 dead, 417 injured

A common theme throughout the subsequent enquiries was:
“We told you this was dangerous….”
“There have been many incidents showing it to be dangerous….”;
“You – management – have not fixed this known problem….”

The UK Parliament subsequently passed a law creating the offence of Corporate Manslaughter.
Victoria has a similar law.
States have workplace safety laws with, in NSW, severe jail time for breaches.

I look forward to perhaps Ms Spence, Mr Harfield and/or any lawyer who wishes to comment on this post either rubbishing my view or explaining where we go from here……………..

In the meantime, would anyone like to buy my aircraft; flying is getting too dangerous for me!!

I presume this ban doesn't filter through to the subsidies? Network planes were flying through TIBA last Friday.

Interesting. Some miscommunication on ATC strikes. During April & May, the ATCs overwhelming voted in favour of Protected Industrial Action (PIA) however there are last minute negotiations to secure an agreement. At this point no PIA has occurred. TIBA or RED CAP (Reduced Capacity) has been ongoing because of not enough ATCs are available due to a range of reasons, sick leave, special leave, or simply insufficient qualified ATCs to fill all the shifts (even with high levels of Overtime).

Going back to NYE 2023, East Group in Brisbane Centre and Honiara and Nauru FIRs were TIBA.

In principle, individual officers of e.g. CASA and Airservices as well as the entities themselves are exposed to considerable liability, Advance. For example, there was a flurry of ruffled feathers / scared horses when WHS legislation imposed personal liability - including exposure to criminal penalties - on persons "involved in the management" of organisations including CASA and Airservices.

But in relation to e.g. airspace arrangements and the omnishambles that is Airservices and CASA OAR, the exposure is not really from WHS laws. It's more that CASA has powers - lots of powers - to do 'things' about airspace arrangements and an ANSP that CASA has certified, the risks to the safety of air navigation arising from the omnishambles are patently obvious, and CASA appears to be doing nothing. It appears that everyone - including ATSB - is hanging on in quiet desperation, hoping that the roulette wheel is sufficiently large that the number 00 doesn't come up for an RPT aircraft in their life time. If it does come up while the omnishambles persists, the Royal Commission Report and Coronial Inquiry Report and judicial decisions will mostly write themselves.
