Hello Experts.

CAP 371 says that min rest for up to 12 hours duty is 12 hours but can be reduced to 11 without need for discretion report.

Question: Can you be rostered for only 11 hours rest or must you be rostered for 12 hours rest which can be reduced by the Captain to 11 without need for a discretion report?

In other words, who does the discretion belong to? The company or the Captain?

This is a form of "Captains discretion" and as such I would always file a report to cover myself. The overiding requirement to watch is the need to have at least 10hrs at the hotel which catches out a lot of people. If the hotel is a long way from the airport you need the 12hrs off to get the 10hrs in the bed.......

In GF min rest was 9hours from hotel checkin to hotel check out.
Captain SOP was not to give a new departure time to ground staff on landing but phone it in when all your crew actually had checked in at the hotel and been issued keys to made up rooms that you had seen.
They then actually answered the phone on such occasions as they were under pressure from Bahrain.
This technique also ensured ground staff actually cared and aided you to clear customs and immigration on arrival by seeking to get your bags to you and see you onto transport to the hotel PDQ.
Give em an ETD at the aircraft and you would be abandoned.
Then generally you waited for bags and transport until the Captain or FSS organised it.
Just getting office and ground staff to do their job correctly and not to lie to crews was the hardest part of every trip for the Captain and Fss.

Under CAP371, flight deck must have 12hrs rest at base and normally a minimum of 11hrs down route or the same as the preceeding duty which ever is the greater.

Sorry to disagree with ETOPS (honest!), but this has been thrashed out before, and I'm certain it is NOT C's D. The company can roster 11hrs rest away from base as long as they provide 'suitable accomodation'

If away from base and the rest period earned is 12 hours then the rest may be reduced by up to one hour, provided suitable accomodation is provided and the travel time between the accommodation and the reporting point is less than 30 mins. If the travelling time is more than 30 mins then the rest must be increased by the amount the journey exceeds 30 mins. This is not discretion and may be rostered. However, if the rest period earned is more than 12 hours then the rest can only be reduced at captains discretion

CAP371 Section A 17.2.1 refers.

However, please note that in the UK it is your company FTL scheme that you should refer to. All company FTL schemes are interpretations of CAP371 and are approved by the CAA. Not all schemes will be the same and some may have omitted certain parts or introduced additional limits.
