I believe that the new ICAO SID/STAR phraseologies would very simply clear up any misunderstanding on this point.

Although globally, implementation is very slow. The UK say no action until end 2017.

So in late 2017 maybe the confusion will be cleared up.

I know things take time - but this proposal had been around for some time before it was formally published by ICAO.
