On the limited information in this thread, Yes! - assuming that the pilots concerned were sufficiently associated with the contract before it was lost. If on the other hand the contract was just one of many which they (the pilots) worked on, then No! Trust a lawyer to have two answers
. They really have to be part of a recognisable unit or entity assigned to that contract for TUPE to apply.
