I think there would be no litigation if the US law had provisions and loopholes allowing for frivolous lawsuits as such…
As for Spanish being almost like an official language in many of the southwestern States, That is due to the historical fact these territories once belonged to Mexico.
The US Government bought some of this land and I was told that there was an agreement to keep Spanish in the status it holds now.
