Flight Instructors annomolies in rules

Should one read on the NZCAA web sight (caa.govt.nz) the requirements to be a category C,B,or A Cat Instructors there is a clash of rules.
The 'Consolidated rule state categorically, that to be Issued with a Flight Instructor Rating one MUST hold at least a Commercial Pilots Licence(CPL)
Unfortunately this is what most readers observe and if they are medically degraded to a PPL it is assumed that one cannot hold a A,B,or C cat instructor rating.
WRONG.
Part 61. ( not the consolidation) the Part 61 dated 01-10-1992. This has not been rescinded! States that a PPL may hold an Instructor Rating provided they have met the academic requirements of a CPL.

(d) to be eligible for the issue of a Category B Flight Instructor Rating a person shall-
(1) be the holder of at least a current commercial pilot licence for the appropriate aircraft category except that, for aeroplane instruction a person may be the holder of a current private pilot licence (aeroplane) provided that person has complied with the written examination, training, and experience requirements prescribed for the initial issue of a commercial pilot licence (Aeroplane).........

What is the next step? could an RPL instruct if he/she had held an instructor rating but was degraded on medical grounds only (not Financial) as some CAA staff interpret the rules this is not allowed.
