I asked caa 8 years ago about the following;
1/ A TV Producer's company rents helicopter and pilot.
2/ He also employs a cameraman.
3/ Task is aerial filming with cameraman, who is deemed crew under "aerial work" regs.
4/But producer directs flight from front seat so is he crew or client and is flight air work or charter?
One dubious suggestion was for the producer to bill the heli company for his labour for work as crew this fee is then added to the charter invoice to the producer's company.
In response, CAA said the regs were imperfectly written and interpretations would need to be tested in court.
