This is the response I received from the JPAC in response to my written query:


Good afternoon

Thank you for your enquiry.

Please see below the following information JPAC EC have been provided -

Having left regular service with an immediate pension under AFPS 1975 or AFPS 2005

Should this be the case, personnel no longer have to have a 30 day gap in service in order to retain their lump sums i.e. Terminal grant and/or Resettlement Commutation lump sum.

Their pension is subject to abatement as per the usual rules.

Having left regular service with a Preserved Pension and Resettlement Grant (RG)

A break in service of 30 days is required in order to keep the RG. Should they come in within the 30 days then they will be expected to repay the RG in full.

Having left regular service with EDP benefits under AFPS 2005

No rule changes for these personnel. EDP income will cease for the duration of re-employment and they will be expected to repay the unexpired portion of their EDP lump sum.
EDP lump sums equate to a period of time as based against their final pensionable pay. An example of this would be an EDP lump sum of £25,000; final pay of £20,000 therefore if final pay equals 365 days then for this example the EDP lump sum equates to £25000/£20000 x 365 = 456 days.

Therefore in this example the person would need to stay out of service for 456 days in order to keep the whole lump sum. Should they come in within that time then the unexpired amount of time is converted into cash and is required to be repaid.
