I can't keep up with the changes - I left under AFPS75 (albeit 10 yrs ago) and had the 30 day gap reqt but in the end just spent longer enjoying the grauity before coming back to a different FTRS job but at the same retd rank so lost out in that I paid back commuted amount - it was also FC.

It seems that our pool of experts today are no match for the permanent team on the old Reservist Staff at PMC (yes Binnsworth) where one particular retd officer could quote chapter and verse without error! If he said it it was true it would happen!

I rejected the AFPS05 offer to transfer - after years of banter of 'you idiot, what did you do that for', I now have a somewhat smug view on my face...

...doesn't help you though, mate. You could try the Pension Ombudsman and claim that the MOD mis-sold you a pension when you transfered without being told about the implications on future FTRS employment?

Leon - I can understand your point of view, but I don't think it's too bad. All it means is if I want to go FTRS, I will have to wait until my 55th birthday, take my full pension & gratuity then move across. There is little total benefit from leaving early on 05 as the pension is abated to cover the 2nd EDP. Trouble is, it does feel good having that 2nd gratuity aged 65.

And of course my salary & pension are higher, and have been since 2005, than if I had not moved over to 05.

This is the response I received from the JPAC in response to my written query:


Good afternoon

Thank you for your enquiry.

Please see below the following information JPAC EC have been provided -

Having left regular service with an immediate pension under AFPS 1975 or AFPS 2005

Should this be the case, personnel no longer have to have a 30 day gap in service in order to retain their lump sums i.e. Terminal grant and/or Resettlement Commutation lump sum.

Their pension is subject to abatement as per the usual rules.

Having left regular service with a Preserved Pension and Resettlement Grant (RG)

A break in service of 30 days is required in order to keep the RG. Should they come in within the 30 days then they will be expected to repay the RG in full.

Having left regular service with EDP benefits under AFPS 2005

No rule changes for these personnel. EDP income will cease for the duration of re-employment and they will be expected to repay the unexpired portion of their EDP lump sum.
EDP lump sums equate to a period of time as based against their final pensionable pay. An example of this would be an EDP lump sum of £25,000; final pay of £20,000 therefore if final pay equals 365 days then for this example the EDP lump sum equates to £25000/£20000 x 365 = 456 days.

Therefore in this example the person would need to stay out of service for 456 days in order to keep the whole lump sum. Should they come in within that time then the unexpired amount of time is converted into cash and is required to be repaid.

I have attached the AFPS Booklet “Re-employment” that provides the full rules and regulations. I trust this information does answer your points raised however should you still require further clarification please write to the Pensions Division at the address details shown below –

NEWS - CHANGE TO FTRS TACOS

As of 5 Jan 15, all new engagements and re-engagements on RAF FTRS(LC/HC) TACOS can be made for up to 9 years or age 65 years (whichever is sooner). The latest Reserve Forces Admin Instruction (AI) applies.
