Do you really need an answer to this. Use a bit of common sense. DW's regs say 1200' twin or 1700' single engine. But still must comply with min heights over populated areas. The rules you refer to are to comply with VFR, if the weather is such that you can't, ask for SVFR clearance - Clear of Cloud + in sight of surface
