Junior First Officers JF/O’s and STC’s

Why is a Junior First Officer allowed to sit in the right seat of a Widebody Commercial Jetliner (with just under 400 passengers onboard) when he/she has failed their QL upgrade check to First Officer?

Why has the HKCAD allowed this? What happens if the said JF/O contributed to an incident or an accident? Will this expose CX to some kind if liability in a subsequent inquiry (Japan, Korea, Taiwan where they held pilots in jail or USA)?

Does other jurisdictions in the world allow pilots to maintain an operating seat when they have failed a check? Do they know CX does this? Does the public know this?

Why is it we don’t have the same situations for Captains who fail their commands?

Or is it one of those hoops that you must jump. I suppose it's not to understand, it just the CX way.

Why is a Senior Check and Trainer allowed to maintain his STC status( or Command Status) after receiving four 2’s (minimum standard) on his recent Proficiency Check? Or it just a rumour.

Must be a different standard.
