Course Completion Certificate

I understand that an instructor can sign the CCC in accordance with FCL740 if the rating expired no more than three years before and the rating concerned a non-high-performance single-engine piston class rating or a TMG class rating. However in the case of an applicant who does not require refresher training because the rating has expired by less than three months or he is the holder of a current rating on another licence eg. FAA , can the instructor/examiner sign the CCC stating training not required or does it have to be done by an ATO or DTO ?
