Justice Harts comments in sentencing make interesting reading for those make the 'back of the clock' drive home.

It is interesting that there is no mention that the vehicle towing was unsuitable for the weight towed and this would have had a signifcant effect in pushing the whole ensemble down the hill on to the track.

Fatigue was certainly a contributing factor but so was the vehicles inability to stop !

All motorway bridges over railways are now protected by concrete parapets following a fuel tanker crashing off the M56 on to the West Coast Main Line near Runcorn some years ago but this vehicle came off a long way before and slid a substantial distance (off road tyres are useless at stopping a vehicle doing 50+ mph on wet grass !)

Whilst his falling asleep was contributory, his stupidity in what he towed with what is even more damning and leads on to the whole debates about caravans etc and licencing of drivers/vehicles.

After all most motorway accidents these days seem to be caravans attempting to rotate without any call of " V1 " or " Rotate" from the driver !

Bill - FYI

The vehicle he used to tow was a Land Rover which has a rated tow rate of 4 ton with the correct coupling (pin and tow eye) 3.5 ton with a conventional 50mm ball coupling. So there is no issue with weight. Car trailer no more than 0.5 ton and car could not be 3 ton, even if it was it would still be within the towing capacity of the vehicle.

So in fact he had the best rated tow vehicle for the load he was carrying.

Unhappy

A large proportion of the motorway accidents that I know of seem to be caused by lorry drivers nodding off. They are usually charged with driving without due care and attention.Does this mean that the charge and sentence is based on the effects and not the offence committed? If so this must have implications for pilots.

Firstly, in my experience of commuting up and down the M1 and in a previous existence the M25, I have seen many accidents, not one of which involved a caravan. Generally the [totally subjective] cause seems to be idiots in BMW's driving to a completely different set of rules to the rest of us. The sooner we issue the Police with ropes long enough to hang speeding drivers from the nearest lamp post the better.

Secondly, I feel there has been an element of blamimg 'pilot error' for this accident. Whilst in no way supporting the driver I suspect that the motorway engineer who designed the crash barriers allowing a gap big enough for any vehicle to pass through near such a major railway line, indeed any other road or railway line, has great difficulty sleeping.

Cool

This was rather self-inflicted on the part of the driver as he had spent the whole of the previous night in internet chat rooms. He then set off knowing that he was not properly rested.

Guvnor,
Seeing as how you clearly spend 95%of your time on the internet and pprune(I guess the other 5% is used for bodily functions),does this mean that you are never in a fit state to drive? That is of course assuming that you have the hand/eye coordination to perform such a demanding task.

Tyrannosaurus....

If, as you suggest the Guvnor does spend 95% of his time on PPRuNe and 5% on bodily functions where does he find the time to drive anywhere....?

Steve, you ar$e!!!!

It's those bl00dy shed draggers blocking up the roads that cause the rest of us to speed when we actually find a bit of clear road.

It's not speed that kills, it's the sudden deceleration. There is nothing wrong with driving quickly as long as it's done sensibly ie not right up somebody's back end!

Smug gits driving at 40mph moralising about the rest of us get right on my tits!

Gary Hart acted like a Pratt, but if all of you are really honest, are there any of us who can say that we have never driven when you have been up all nite, and feel like your eyes need propping open with match sticks, Nurse's , Policemen/women, shift workers Airline pilots, road workers, in fact the whole spectrum of everyday job holders sometimes have to drive when their body clock is screaming at them to sleep.

Gary Hart did not set out to kill any one, in fact he was sure he was going to get laid, but he was involved in a dreadful accident, the penalty he has been given in my humble opinion is correct and just, but what dosn't help, and I feel is distastful, is a poe faced police man crowing to the TV reporters, about being happy that he( Gary Hart) is going to prison. I feel very sorry for the bereaved and the injured, but I also feel justice has been served, and been seen to be served!
And the earlier post about Landrovers was right, NOTHING beats a Landrover in towing anything.
