Brookfield now is un-willing to divulge their true Corporate name after 6 requests;
Brookfield Aviation International
Brookfield Aviation International Ltd.
Brookfield Aviation International Limited.
Obviously trying to make a legal action more difficult.
What do you Ryanair guys have written on your Agreements?
Also Brookfield has now by default (they could have agreed to the entire process to be done in English) forced Chinese as the language for the Arbitration.
Why we wonder - U.K. company - Native English speakers?
Now the original Post.


Are you currently or previously on a Brookfield Contract/Agreement?
Are you or were working for them in China?
Does your Contract/Agreement specify that the legal jurisdiction is China?
Are you or were experiencing the following;
Partial or non-payments?
Missing days off or vacation?
Misleading statements or promises not kept?
Suspected mismanagement of your funds/Fees?

Does not matter how small the amount is still outstanding, you have a very very good chance to collect.
Take note this is ONLY for Chinese Agreements/Contracts!

This may be of interest to you.
We are five Pilots either working for Air China or the Hainan Group on the A330, B737 or Gulfstream fleets. Two more are watching what happens.

We have started one process through the CHINA INTERNATIONAL ECONOMIC AND TRADE ARBITRATION COMMISSION (CIETAC).
Filing Fee is RMB 10,000.
Then another RMB 10,000 as the min. covering the amounts owing.
This has already been paid as a collective group.

This legal process will require Brookfield/or their Legal Representative to appear before the CIETAC here in Beijing and make their defense in late October 2010.

The CIETAC is a tribunal where 3 Judges review the arguments and claims. Once the CIETAC makes their judgement, in favour of us, and as all Contracts/Agreements are exactly written or very similar wording, then the CIETAC will make similar awards without having to file individually.
That is a huge cost and time saving benefit.

This judgement when issued and if not paid promptly, can be legally collected directly in the U.K. using a Collection Agency.

From the number of people involved and the determination, you can see that Agency representation in this Region is very questionable and does usually require legal action in the end.
