I think you may have misunderstood my post Highlander. The company did keep them on at full basic pay until the report was released, I would have expected nothing less and that was the point I was trying to make to Chrome.

Yes, the crew were accountable and it was their degree of accountability that eventually decided the outcome. Having flown with SIA on the 744 for ten years I am well aware of what it must have been like, in Taipei, on that night, been there, done that.

Just because the "authorities" said it was prohibited material, doesn't mean it's so, unless he has admitted/acknowledged that the material is illegal. Let the Captain have his day in court.

Maybe some locals could let the forum know what search rights the Australian authorities have and what our rights are against illegal search and seizure. What about probable cause? Did the authoritites ask permission from the Capt to search his computer and did he grant permission?

My brother, who is a cop (albiet not in Autralia), tells me that whenever any law enforcement asks to search, you should ALWAYS say no. Put the accountability for probable cause squarely on the shoulders of the fuzz regardless how innocent you think you are.

The way it has been presented down here in Oz is that the crew members concerned had signed a declaration that they were not importing anything illegal to Australia. Child porn is definitely illegal and I presume that Oz Customs have a right of search if they have reason to be suspicious.

Certainly sounds as though there have been tip offs though, doesn't it?

Para - the document that is signed when you arrive in wonderful Australia is so general "Have you got anything of interest to customs" that they can get you on anything they want.

Rumour has it that the "child" porn he had was the infamous "Tammy video". This is a home made on the phone video recorded by a female school student, and a national service boy, in Singapore, having sex. Every second man in Singapore has seen it, or has it, in some form of media. The other porn was Japanese stuff above age. Again rumour

If this is the case then I feel he has been really hard done by and I hope that the company stick by him. If he has the commercially produced pedophile porn then throw the book at him.

Although I'm no expert, possession of "normal older age" porn is not a crime in Oz and you shouldn't get into trouble for that. They might even want to copy your collection for themselves if they like what they see.

Parabellum. Thank you for the clarification - I believe, now, we are on the same page. Been there, done that; and will continue - to go there, and do that !

Now back to this thread. So the issues are :

1. What constitutes unlawful data ?
2. What are the legal powers of Customs and Excise, in various countries, to demand viewing personal electronic data and how can they do it ?
3. Who is watching your electronic data trail and how ?
4. What onus does Customs and Excise have to prove reasonable suspicion ?
5. What constitutes a thorough search ?
6. What rights does a pax or crew have when questioned or searched ?
7. Will this paranoia about security ever end ?

Personally, unless the Customs in OZ were acting on a tip-off (and can prove it) - the crew involved should have denied access to their data unless a written warrant was produced; I don't know the details of the search, but it wouldn't surprise me if the search wasn't fully legal from the start; however, if they got the voluntary co-operation from the crew then it's a no-brainer. Either way, once the contraband was found, the guys involved would be living a truly 'porn' experience - if you know what I mean.

Get this right

Leave the captain alone... He was only found with pornography, not child pornography... Not like the half the world does not have pornography in their computer... The newspapers have not gotten their facts right and you guys are adding salt into the wounds of others... Is it very nice to gossip about others... Imagine if you are in the same situation and people who you do not know make judgements on you... Shame on you people... Not as if you have not made a mistake before... Their families must be very worried now about their future, the nicest thing you could do is stop commenting until the end of the trial... If what you have said is untrue and defamed him... PLEASE THINK BEFORE YOU WRITE... If I'm the family of the captain, I will sue you...

Seems most press reports even the most recent ones mention child pornogaphy.

SINGAPORE, Feb 13 (Reuters) - A Singapore Airlines pilot was fined A$12,000 ($10,860) for trying to bring child pornography into Australia, court documents showed on Wednesday.

Ng Kok Yauw, 40, captained a Singapore Airlines flight last Saturday from the city-state to Adelaide, Australia, when customs officials searched his laptop and found video clips of child pornography, Adelaide court documents seen by Reuters said.

Ng, who appeared in court on Monday, pleaded guilty to charges of importing banned material and making a false statement to a customs officer.

He could not be reached for comment but Singapore Airlines, the world's second-largest airline by market value, said the airline was conducting its own investigation.

relax mate.. no caning, they would have copied it off his laptop.. if they searched it in the 1st place. Most of us have jap porn anyways...

Wonder how Qantas tech crew would feel if customs in SIN searched their laptop?

again rumour has it they took his laptop into a room and it was out of his sight for a while.... if that is true.. I wonder if it is legal to do that.

What IF one of those kids where one of yours!!!!! Then the double moral standard would kick in. Human nature, but it is wrong to live with it. Who cares about adult porn.
ANYONE PROMOTING CHILD PORN SHOULD TAKE RESPONSABILITY OF THEIR ACTS AND BEAR THE MAXIMUM PENALY FOR IT.
More should be done around the world ,like AUS authorities did ,to put all this people where they belong.

Customs do have the right to strip search you, shove a finger up your jacksie, and go through your laptop/ mobile phone/ address book/ suitcase. They can also arrest you. (And making a false declaration is a crime. Bit like the US and "wire/mail fraud" - it is easy to proove, can carry swinging penalties, so is often used by authorities to "get" people (e.g. Al Capone and tax evasion))

All they need is "reasonable suspicion" BUT they do not need to tell you why they have suspicion, just that they have it. (normally a tip off). They should tell you what the suspicion is about if you ask. But if the suspicion is that you are (say) bringing in pirate DVD's, and they find drugs, but the DVD's are OK, they can still bust you for the drugs.

You can say no, and force them to bring in a magistrate to issue the warrant - but you will be detained until the duty magistrate can be found and the warrant typed up - probably a couple of hours. Once the warrant is issued, you have no right to refuse.

Maybe is my English. I m not a native English speaker. When I wrote PROMOTING I meant that by just having the material of children the "industry" is encouraged to flourish. People watch , download, share and so the evil circle starts. No one protect kids except committed authorities , people brave enough to denounce it and people like us that don't want to turn a blind eye to our neighbor or colleague wrong behavior. The rank , nationality or job is irrelevant. They deserve to be taken out of circulation for good!

Just yesterday my eff oh was mighty worried...someone sent him some porn video clips of caucasian girls; they looked mature enough,but someone cautioned him that underage blondies do look pretty matured and he might get into trouble. He deleted those stuff but is worried sick that it might hide somewhere in his hard disk. He is no techie; so he leaves his laptop at home just in case... now it cost him a bundle to call home from layovers; no skype and net chat now. Also what if someone tip off the local cops and search his home for the laptop. I am no techie either, so I can also suggest he get his hard disk scubbed good!
