Norwegian accuses Boeing of fraud and breach of contract
Google translate to english, original at e24 dot no (when will I be able to post links ??????)
The airline makes sharp accusations against Boeing in the lawsuit after the cancellation of an order for 97 aircraft.
On Monday, Norwegian took the threats seriously and formally filed a lawsuit against the aircraft manufacturer Boeing.
Legal documents from the Illinois Northern District Court, which E24 has been given access to, show that Norwegian and the subsidiary Arctic Aviation Assets DAC together are suing the aircraft manufacturer.
Norwegian notified the lawsuit in connection with the airline canceling an order for 97 aircraft, which according to Boeing has a list price of 12.65 billion dollars, or 122.34 billion kroner.
The airline's lawyer writes in the lawsuit that the lawsuit is due to Boeing's "gross negligence, fraud and breach of contract" related to the purchase of the 737 Max and 787 Dreamliner aircraft.
"Instead of delivering what they promised, Boeing has deliberately misled and omitted information, shown gross negligence and clumsy production, and made aircraft with significantly impaired value and utility, which in the case of the Max aircraft had tragic and fatal consequences," writes Norwegian's lawyer in the lawsuit.
Boeing has not yet responded to E24's request for comment on the lawsuit.

«Full of lies
Norwegian believes it is entitled to a refund of advances that have already been paid, as well as compensation for the problems that have affected the 737 Max and 787 Dreamliner aircraft.
The lawyer writes that Boeing's presentation of the Max planes "was full of lies" without Norwegian being aware of this.
Boeing exerted relentless pressure on its engineers from the start of the program to prioritize quantity over quality, proven they used "jedi tricks" to get the FAA to approve the aircraft's design based on statements from its own employees, and systematically cut corners along the way a very flawed design process that made a plane full of errors ", writes the lawyer.
FAA is the abbreviation for the US Civil Aviation Authority, which is responsible for the approval of the aircraft type.
The Max planes were put on the ground all over the world in March last year after two accidents with the new aircraft type in five months. 346 people lost their lives in the accidents.

Claiming Boeing offered five Dreamliners
It is not only the Max aircraft that have created problems for Norwegian and other airlines. It also has the 787 Dreamliner aircraft type. The aircraft first had problems with overheating of batteries in the take-off phase. Then it also turned out that the engines from Rolls-Royce had problems and had to be frequently checked and serviced.
Norwegian's lawyers claim about the Dreamliner aircraft that Boeing has "refused to deal with the problems" with the aircraft type. Norwegian should instead have been offered to get another five Dreamliner aircraft "which Boeing knows are defective and which will probably be out of service for maintenance at least 20 percent of the time", according to the lawyer.
Norwegian requests that the court rule in favor of the airline around seven points. Four of these are related to Norwegian's desire to cancel the purchase agreement for 97 aircraft and a service agreement.
Compensation is also required for inconveniences caused "due to Boeing's offenses and breach of contract", with an amount to be decided in court. The airline will also have awarded legal costs.

Complaint was originally filed in state court and then removed into federal court by the defendant Boeing, in accord with federal court jurisdictional rules.
The Complaint is accessible on the court's electronic document filing system (Pacer).

Looks like NAS will spend more time in the courts than in the air!

It's never good to let things escalate this way. Hope they come together again somehow. Looks like some financial drama turned into some legal fight.
Wish we could say the charges are unfounded.
