Question Virgin lay offs

I realise this is a very sensitive subject and i do not wish to cause offence but here goes. The notion that Virgin may be looking to lay off people according to type rather than seniority has already been raised but I also heard a rumour (from a friend in the airline) who said that management would be looking at the sickness record of individuals.

Now I thought that was against employment law ie employers could not use performance as a criteria for redundancy. Any lawyers out there?

In virtually every industry other than the airline industry, performance is one of the first criteria considered.

They probably can't make somebody redundant on their sickness performance. But they probably could sack somebody on it. Cheaper for the company.

I always thought that it was very easy for companies to make employees with less than 2 years service redundant without giving any reason.This would make it a lot easier on the company without any fear of legal action from senior employees.
