Post Insurance valid?

Okay, one or two of you out there with a bit of experience on the subject, what is the score with the insurance on the hull and the people if the cockpit crew are flight time illegal?

No guesses thanks, cases and references.

While I am at it, you are a contractor, there is an accident, the operator has the hull etc insured and the insurers pay out. Unfortunately there was some pilot error (there nearly always is)- what is there to stop the insurer(s) coming back on the pilot, or his/her estate?
