Jar-fcl 1.350 & jar-fcl 1.325
Ex-ICAO Flight Instructor (rating expired, total time +20,000 hours, flight instruction time +1,000 hours, has supervised well in excess of the minimum required in the rules below whilst on his non-JAA rating) undertakes a JAA FI(A) Rating. The new JAA FI(A) rating is issued restricted in terms of JAR-FCL 1.325 below.
Does this instructor have to re-comply with 1.325, or does he already comply in terms of his previous (non-JAA) experience?

FI(A) – Rating issue
An applicant for a FI(A) rating
(a) who has complied with the conditions specified in JAR–FCL 1.310, 1.315 and 1.335 through 1.345,
or
(b) who has been issued a specific authorisation in accordance with Appendix 1 to JAR-FCL 1.300, complies with the requirements of JAR-FCL 1.355 and hold a JAR-FCL licence
shall have fulfilled the requirements for the issue of a FI(A) rating, subject to the initial restrictions set out in JAR–FCL 1.325.

FI(A) – Restricted privileges
(a) Restricted period.
Until the holder of a FI(A) rating has completed at least 100 hours flight instruction and, in addition, has supervised at least 25 student solo flights, the privileges of the rating are restricted. The restrictions will be removed from the rating when the above requirements have been met and on the recommendation of the supervising FI(A).

I can only strongly advise to seek answers from the licence issuing authority as all of them use different and very own interpretations.
In the UK and Ireland one can easily assume that everything not achieved under JAR will not be considered, went several times through this interesting discussion with both of them, each time on different issues...
And one more thing, when it comes to training, each CAA has also a different view of accepting a duly certified training organization from a different JAA member country....
To give you an even more confusing aspect, UK and Ireland may recognize a TRTO from another JAA country in terms of a type-rating, however, if same TRTO performs a duly certified course for SFI / TRI, Ireland will not recognize this...
Now, who thought we have things easier these days....
