What is the regulation if I am resitting?

Same as when you sat it the first time... except you've got 1 less chance to make a mess of it before you have to start from the beginning again.

For ATPL exams

*you have 6 chances to visit the CAA centre to take those exams.
*3 chances to resit each subject

If you go over 1 of these, then you will have to sit ALL exams again, which means the ones that you may have already passed, will not count anymore.
