SERA.4001 and these pesky flight plans

Heya. Been out of GA flying for a bit. Trying to get my head around this, as it’s something rather different than what I learned when I first started flying. SERA 4001b says:

A flight plan shall be submitted prior to operating:

1 any flight or portion thereof to be provided with air traffic control service;

2 any IFR flight within advisory airspace;

3 any flight within or into areas, or along routes designated by the competent authority, to facilitate the provision of flight information, alerting and search and rescue services;

4 any flight within or into areas or along routes designated by the competent authority, to facilitate coordination with appropriate military units or with air traffic services units in adjacent States in order to avoid the possible need for interception for the purpose of identification;

5 any flight across international borders, unless otherwise prescribed by the States concerned;

6 any flight planned to operate at night, if leaving the vicinity of an aerodrome.
c A flight plan shall be submitted, before departure, to an air traffic services reporting office or, during flight, transmitted to the appropriate air traffic services unit or air-ground control radio station, unless arrangements have been made for submission of repetitive flight plans.
so if I plan on interacting with a controller or operate into E-B, as a VFR aircraft… I have to file?

i did my initial in France 07-09 and then went to the UK where “booking out” is a thing before going commercial, so this part of SERA never affected my day to day. In France, I never had to file, controlled or uncontrolled.

6c gets my attention.

A flight plan shall be submitted, before departure, to an air traffic services reporting office or, during flight, transmitted to the appropriate air traffic services unit or air-ground control radio station
is this the loophole? Does calling up ground to get a clearance, or approach to get a transit clearance, considered a form of flight plan submission?

It sounds like it’s saying that it has be a formal flight plan submission.
