The answer to the exam question is unambiguously choice a. But you are asking what happens if the give-way aircraft does not give way. The answer to that one is nothing relieves you of responsibility to avoid collisions, not even having the right of way. So ultimately, you give way if they don't.

Thanks, it was simply a concern; ultimately it’s up to me which course of action I would take and the logical thing to do would be is to turn right. However it would be the wrong answer in the air law exam. As it states one should maintain heading and speed! Even although it states there is a risk of collision.

I’m assuming I should be checking for a constant relative bearing of the other aircraft? It just seems to be a little ambiguous. But again thanks for your input.
