Svfr Jersey Zone

Why is the Jersey zone class A, requiring 5km vis for clearance. Which could lead to the situation where you are totally legal VFR over the water and get to Jersey or Alderney etc, and no clearance meaning a divert to a French field? Which of course is perfectly legal.
