Fit and Proper Person in Enzed

hi guys
hope everyone is well

I am planning to go to NZ for CPL and have a DUI offense in Australia back in 2005.

has anyone been refused the Fit and Proper person certificate in NZ due to DUI? what are my options if they refuse to issue me a certificate.

Don't know anybody personally that has failed to get one issued. But then again, I don't know anybody with a DUI who has applied.

As for your options, the short answer is that No fit and proper = No License.

Having said that, a DUI will not automatically disqualify you from being classed as fit and proper. As I understand it, it is done on a case by case basis.

Your best bet is to probably send in the form before you do anything else... they don't charge you to process it and that way you'll know whether or not getting issued a license is possible before you spend large amounts of fun tickets...

It's "valid" for 24 months, and getting it 're-issued' is basically signing a declaration form saying "nothing has changed since I did the last one"

Thanks for the reply. I just had a go at filling the form but it says it needs to be attached with an aviation license/rating application/nomination of a senior position.

I would be eager to hear from people who have dealt with NZCAA with a DUI offense under their belt.

I had my license revoked for 7 months and no further cancellation due to stupid behavior or anything.

I know of someone (a student) who got done for drunk driving prior to getting a PPL. There was a six month stand down period, followed by a PPL flight test resit. They managed to get through the Fit and Proper Person process.

Thanks for that. i have communicated with NZCAA and they cant advise on this as it is on a "case by case" basis.

Since i would have been a overseas PPL holder, I dont want to take the risk of booking my flights/paying fees etc only to be refused the fit and proper person certificate.

Man i am lost now!

When you had your DUI offence in 2005, were you pulled up at a checkpoint and found to be just slightly over the limit? I'm sure that wouldn't exclude you from the ranks of all those other fit & proper persons in NZ.

that was exactly my case. RBT pulled me over. quite honestly, this has created a lot of problems (limiting my options for overseas travel etc).

i just dont know whether to go ahead with my plan to go to NZ or not. I dont want to do all my training and then find out that I dont qualify to hold Fit and Proper person.

I dont have any other conviction.

Something else to consider

Just be aware that you could potentially be deemed "fit and proper" to hold a PPL for example, but you may not be considered "fit and proper" to hold a higher licence when you come to apply for it.

I have heard of 1 guy sending away his paperwork for the issue of an ATPL and having old DUI's pop up, even though they were before he had his CPL issued?? I guess higher licence = higher responsibility. It was a while ago now however, and he did get the licence issued in the end.

Please bear in mind that this is all second hand information but a student I had with a DUI in Aussie came out here to Noo Zuland to do CPL training.
They passed the fit and proper requirements as in Oz a first DUI is considered a traffic offence not a criminal offence as it is on this side of the Tasman......Again treat this as very 2nd hand......

Heh... I just had a quick look at the form and the very first thing mentioned is:

"Fit and Proper determinations can only be made at the time of application for an aviation document or nomination for a senior position."

Doh! That's a bit crap TBH... not being able to find out until you've spent all the $$$ on the training

I suppose you could try converting your PPL as a first step... and apply for FPP then, so you'd find out without too much cost. However, as mentioned, this is no guarantee that they will let you upgrade to a CPL.

Give licencing a call. Be upfront and tell them about a youthful mistake. Ask them where you'd sit WRT to the fit and proper test. In my experience, disclose everything and lay your cards on the table. It'll work in your favour. I'm sure it wont be a problem.

Hell, I know guys who've shown up to work (flying jobs) and been sacked for being under the influence and still kept their licences.
