Seating Capacity change and Refueling Reg's

Hi,

With CAO 20.09 4.2.1 (Aircraft max seating capacity > 20 for pax onboard during refueling) if you have an aircraft like a DH8-100 and configure it with 10 seats using the rest for freight on a permament basis, would that change the maximum seating capacity according to the reg's for refueling with pax or not?

The only reason for not hearding them off during refueling is the event of going to alternate enroute to take on extra fuel due to higher fuel burn where customs are expecting to clear us at our destination instead of the alternate.

My view on it is the max seating has changed to 10, we're at an international airport with customs, they should clear customs and we continue the flight domestic or they get off and stand in a clear area supervised by quarantine and customs until they reboard.

Any advice on the rules?
