Identification and Prosecution of Social Network Site Users
Gentlemen,

There may be some truth in these rumours. There's a well-publicised case in the UK at the moment involving South Shields Council and a blogger known as Mr Monkey. The Council have taken legal action in California courts to identify Mr Monkey in order to prosecute him/her for Defamation of an assortment of Councillors and Council officials.

If you Google "South Shields Council Blogger Prosecution" or something similar, you'll find lots of articles on the subject. Probably the person who posted actual names & identifying details of certain EY staff and those who then made disparaging remarks about said person's private life.

Which not only goes against the rules of PPRuNe but I think leaves them totally open to whatever EY are trying to do here. Am I wrong?

It would appear that a great number of pilots in the Middle East are receiving notices from a number of entities in the US as a result of these subpoenas; the traffic is coming not just from Nabarro themselves but from web-mail hosts such as Google (Gmail) and Microsoft (Hotmail) informing those whose identities have clearly been provided to Nabarro of impending action.

The gist of the notice is as follows:


Google/ Microsoft has received a subpoena for information related to your Google/Microsoft account in a case entitled Etihad Airways and XXXXXXXXXX v. Does 1 through 100, inclusive, Superior Court of California, County of Los Angeles, BC459787 (Internal Ref. No. 140203).

To comply with the law, unless you provide us with a copy of a motion to quash the subpoena (or other formal objection filed in court) via email at [email protected] by 5pm Pacific Time on June 22, 2011, Google/Microsoft may provide responsive documents on this date.

Very nervous times for a number of members of this website. The facility will continue to exist for any other entity to obtain your details in the event that they are so inclined, merely by launching the same subpoena action.

It is only a matter of time before this cautionary notice is blown out of the water; please provide the necessary onward warning to all other users of this site by repopulating this warning in the event that this does occur.

Jetjock & others, still nothing from any Mod. Still nothing from anyone, official at Pprune. Now why do you think that is ? JJ, reading the bottom of the side page; do it again. Nothing really testy there. Just a warning that OTHERS, like the Press ,could download your contribution and then use it themselves. I also note that no-one has suggested reading the "Privacy Policy" also at the bottom of the site page. By revealing your personal details to anyone, having specified that they would not, PPrune would have a major headache if you decided to sue for breach of confidentiality. Remember, British Law is also made up of "precedence". Where a Judge makes a ruling in Court, that becomes, IMMEDIATELY, a law. Lots & lots of that. Even Sienna Miller picked up 100K the other day !! Like she needs it.

The Middle East is not within the Jurisdiction of the US Courts. How are they going to pursue you ? Go for extradition. Let them try. Really would make them look rather daft don't you think ?

And finally, EY Management, I think, a pretty decent bunch of chaps who are probably having a right ole chuckle at all this nonsense. They are far too busy with really important stuff to take umbrage at a few of us who have a rant & take a poke at someone close. Good mate of mine, ex GF when RH was there, tells me that he had a very minor quibble, went straight to the door, which was always open. RH was extremely busy with really important stuff but stopped, gave the guy a coffee, told him to calm down and that he would look into the matter but gave him a minor bollicking by reminding him of the complaints procedure. The case was resolved within days.

Now, calm down everyone. PPrune is being tarnished by all this nonsense & makes the nervous little flowers like you lot, not want to participate. It is a great "Venting" room too. So, c,mon, lets get back to Rumours and news & lets take a swing at someone. Yeah, name & shame em !!

That is not the point. The subpoena is for your contact information. Once they have your full contact information then they can put their appropriate class action through whatever court system they wish, which sadly in this case will be the UAE. Do not pass Go do not collect end of employment benefits etc etc. Even sadder is that there is no employment legislation to help the people concerned. I am sure there are some very worried people around which is not a healthy situation in an aviation environment. The total silence from the site administrators/Mods is either a cruel joke or they have been told to stay well out and make no comment or further participation that may render the site owners as complicit in propagating the 'rumours' that EY want to stamp out.

Slag someone off and be ready for the consequences. Once upon a time it took the form of a thorough beating to seek redress. Now it is done thorough a court system some where. The net outcome is probably the same. Using your real name tends to keep one honest.

Be very careful , even after an apology if a crime has been committed the court system will continue.
Cut losses and leave , it will be harder to get a job in the real world with a criminal record.
