S/O bypass pay

Can somebody enlighten me what the new COS08 bypass pay section is trying to say? It seems like S/O now doesn't need to be assessed before they get JFO bypass pay.

It doesn't matter what the COS says about bypass pay. A 'court of law' has decided that CX can pick and choose when they want to pay it, regardless of what is in your contract.
