Ansett employees may not benefit from ticket tax
The Commonwealth Government has told the Federal Court it is wrong to assume any of the money collected under the airline ticket tax will be passed on to Ansett's administrators or employees.
Counsel for the Government, Robin Brett, says it may be that none of the money is handed over.
Lawyers for the administrators and the unions told the court the tax money, expected to be more than $100 million, is critical to the settlement of Ansett's affairs.
However, Mr Brett says if the administrators manage to cover the company's outstanding liabilities, the funds from the tax would be kept by the Government.
The Australian Council of Trade Unions' legal officer, Andrew Watson, says it is an extraordinary revelation.
"Counsel for the Commonwealth has let the cat out of the bag," he said.
"The Government has been collecting a ticket tax, collecting millions and millions of dollars and counsel has just said not a single cent of that will necessarily go to employees.
"Basically the Government's current position is that, in affect, they will pocket the tax."
However, the Federal Transport Minister, John Anderson, is insisting money raised from the levy will be used to fund Ansett workers' entitlements.
Mr Anderson says the money will be given to the administrators to fund entitlements.
He has attacked the Australian Council of Trade Unions for its criticism of him over the matter.
"If they're on the side of workers, if they have a shred of decency, if they're not simply about political opportunism, it is high time the ACTU... acknowledged that we have done things for workers in this country that no Labor government ever did," he did.
