How do you make a claim against a European based operator?
Need to chase some monies owed by an Austrian based operator.
Not a huge amount (under £10K) but do not want co to get away with it.
All phone calls to chase up go straight to answerphone with no facility to leave a message.
emails are getting ingnored (although am getting a read-receipt to say they have been opened) and letters are being ignored.
Anyone made a legal claim against an operator and how did you go about it?
Any advice/links would be greatly appreciated.

I'd suggest getting in touch with an Austrian lawyer and getting advice about the claims procedures to follow there.

Put a claim on the company and have a specialised lawyer ground the aircraft when it is in your country tend to get their attention. Just letting them know that you will do that also helps

It did not work against IJM
I know several pilots who are owed money by a "well known" operator, and even the promise of a Lien was wasted, several guys spent a lot of money, but as they were on off shore contracts, all failed in recovering the funds, directly.
I believe that at least one pilot recovered cash by ensuring that his new company got a big charter that was going towards IJM, and thus the commission went to him to assist in his liquidity.

I think we know whom this is etc, its a real shame etc. Do not do anything Illegal etc.
I know a very good european lawer whom carrys out commercial cases etc. unfortunately to claim 10K is going to cost you something estimate 20%.
Depending on the Register you could place a Mechanics lien on the aircraft but this is based on unpaid bills relating to maintenance.
You could always offer to fly? then as your pulling out of the chocks call operations and tell them you have a delay until clear funds are in your account.
