Part 135 Gulfstream GIV's without a FDR?

Anybody out there operating an older GIV (1988-1990) on a Part 135 certificate without a FDR? Having a battle with the FAA on this issue.The regulation is not real clear regarding FAR135.152. Any thoughts would be appreciated.

I am not certain but I think you don't need one until 2012.
