Why? Who says so? If you bought cheap housing under the flight path then live with it or p1ss off and live somewhere else.
You obviously don't live in Sydney do you? If you did you would realise that basically half the town is under a flight path of some description. Including some some very expensive real estate.

And for the record I'm nowhere near the airport or under a flight path.

Neville, sorry the freccin airport has been there since Pontous was a pilot, like the people in HK, SFO, LAX, BNE, and all points north, don't buy a house under it if it annoys you. Yes I lived in the Eastern Surburbs for forty years and 2/5 was a tad noisy especially in the days of the DC9 etc, but if Sydney is to come of age the curfew has to be lifted sooner or later or we remain a hick town. Simple as that. Bloody ridiculous that PAX had to sit in a A/C in CBR for eight hours, Im afraid in my time we used to notice some vibration in nbr 2.................

SACF has even had to consider noise complaints from people living 20 NM northwest of Sydney (16 PRM). These are the real whingers, not the millions of people newly exposed to noise after the 3rd runway and then LTOP.
Say require, no ATC is going to deny you a landing clearance - in fact ATC hate doing the dirty work of the pollies.
Exactly... in fact ATC does NOT police the requirements of the Curfew Act. If there's a possible breach, they're required to give a warning something along the lines of "curfew restrictions, penalties apply, advise intentions".

AFAIK all penalties for breaching curfew fall on the captain of the aircraft, not the owner/operator. Check your AIP.
